Motion to dismiss for Mandamus (i601a)
I would like share my experience with "writ of mandamus." the response what I got was 'motion to dismiss'. which really what wasn't I expected.
before I was filing I was checking youtube videos of different lawyers, none of them really was saying about that the government can really do something like motion to dismiss. may be it is my fault beacuse I didn't do enough checking. anyway now I been in this situation and now I need to spend more money to fight the motion to dismiss. I called couple of lawyers to know how much they are charging for that and 1 said $7500 and another one said they can't take my case. and my own lawyers still didn't gave me a figure. what I believe is there were people who filed the Mandamus was getting approved till couple of months ago and now recently I didn't hear any got approved. it may beacuse of uscis find a new way to stop getting suing or it may be beacuse of my specific case.
Unfortunately if the money that my lawyer asking is unaffordable for me I have to cancel the Mandamus. Which my hope ends.
It's really hard to see people who doing fake marriage and assylums just beacuse they have money are getting approved way faster while me who is genuinely married for 3 years and having 1 child and 1 on the way is struggling to get the approval from USCIS.

My case is transferred to Denver FO on July 10th .
My PD December 13 2022, I have been patiently waiting but also checking on my case once a month to see the updates. I talked to 2 Emma agents this morning both of them said my case is at Denver FO , I was informed last month that my interview marked as waived but I know that could be changed and I live 800 miles away from Denver. How long usually take them to make a decision on the case after arrived at FO on you guys experience? I just got my EAD last month so I don't mind the wait but also like to have some ideas.

That seems to be the end. Im in the EB3 process and we where about to file the PERM but once i saw that pd is now 2020 its basicly useless to proceed. The last month was already bad but now it moved back another 2 years. Even when i have to wait another 8 month till i have my PERM there is no chance that USCIS can catch up a backlog of over 3 years in that time. But i also know im not going back to Germany, i rather hide myself in the mountains.😅
EB3 row has been current for the past 3 years so how can there be a backlog of over 3 years now within 1 month. I dont get that and how much impact can the new fiscal year have.
