2. Cookies, Tracking Tools, Behavioral Advertising, and Opt Out Options

Cookies and Tracking Technologies

Cookies are small data files that may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your device. We use cookies to collect information in order to improve our services and enhance your experience.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, disable cookies or to notify you when receiving a new cookie.

If you do not accept cookies, you may not be able to use some features of our Service and we recommend that you leave them turned on.

Your Choices Regarding Cookies

You can instruct your browser to refuse all cookies or to notify you when a cookie is being sent. The Help feature on most browsers provides information on how to accept cookies, disable cookies or receive notifications when new cookies are sent. While you have the option to disable cookies, please note that doing so may limit your ability to use certain features of our Service, and we recommend keeping them enabled for the best experience.

Tracking Tags

Tracking Tags, also known as clear GIFs or pixel tags, are tiny graphic image files embedded in web pages or emails. These tags help us collect information about how users interact with our Service, selected advertisers' websites, and the emails, special promotions, or newsletters we send. The information collected through Tracking Tags enables us to analyze user behavior, measure the effectiveness of our communications, and improve our interest-based advertising (discussed further below).

Web Service Analytics

We may use third-party analytics services to better understand user interactions with our Service. These services may track activities such as mouse clicks, movements, scrolling behavior, and text input. The information collected helps us improve the usability and functionality of our Service. Generally, these analytics services do not collect Personal Information unless voluntarily provided by you and typically do not track your browsing habits across other web services.

Mobile Device Identifiers

Mobile Device Identifiers are data stored on mobile devices that help us learn more about our users' demographics and online behaviors. These identifiers may track activities on your device and applications, enabling us to collect Personal Information, such as media access control (MAC) addresses, location data, and Log Data. This information is used to personalize and improve the Service.

Data-Sharing Choices, Risks, Benefits, and Limitations

  • Data Sharing Choices: We believe in giving you control over how your data is shared. You can choose to opt out of certain types of data collection, such as cookies, through your browser settings. Additionally, you may limit the information shared by adjusting your preferences within our Service or your device settings.

  • Risks: We take careful steps to protect your data, but it’s important to remember that sharing personal information, especially with third parties, does carry some inherent risk. If you choose to disable tracking technologies or limit data collection, it may affect your access to certain features and services, which could reduce the level of personalization and overall experience within our Service.

  • Benefits: Allowing data collection and sharing enables us to enhance your user experience by providing more personalized content, relevant advertising, and improved service performance. It also helps us identify and resolve technical issues, ensuring a smoother and more secure experience.

  • Limitations: While we work diligently to protect your data using industry-standard practices, it's important to understand that no method of data transmission or storage can be completely without risk. We strive to keep your information secure, but absolute security cannot be guaranteed. Additionally, if you choose to opt out of certain tracking technologies, you may find that some features or services are not as fully accessible or personalized as they could be.

In Simple Terms: We use cookies and other tools to make our service work better for you. You can control these settings in your browser, but turning them off might limit some features.

3. Information Collection And Use

When you use the Service, we collect certain information from you that can be used to contact or identify you, including, but not limited to, your name, gender, date of birth, telephone number, postal address, and email address (“Identity Information”). If you pay a fee for the Service, we will collect additional payment and billing information from you, including, but not limited to, your credit/debit card information or bank account information (“Billing Information”). When using the Service, you may be required to provide information or documents necessary for the preparation or filing of forms or applications to be submitted to government agencies, and if you file an application, we may receive from the government a unique receipt number assigned to your application (“Application Information”). Together, your Identity Information, Billing Information, and Application Information are referred to as “Personal Information.”

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, servicing your purchase orders, and improving our services.

In certain situations, we may share data that has been de-identified, anonymized, or pseudonymized. This means that your Personal Information is transformed in such a way that it can no longer be used to identify you as an individual. De-identified, anonymized, or pseudonymized data may be used for research, analytics, or improving our services. When sharing such data, we ensure that it is handled with the same level of care and protection as your identifiable Personal Information, and we limit the use of this data to the specific purposes outlined.

Generally, no one is under a statutory or contractual obligation to provide any Personal Information. However, certain Personal Information is collected automatically, and if some of the Personal Information is not provided, we may be unable to provide the Service. You agree that any information that you may reveal in a review posting, online discussion, or forum is intended for the public and is not in any way private. Carefully consider whether to disclose any Personal Information in any public posting or forum. Your submission may be seen and/or collected by third parties and may be used by others in ways we are unable to control or predict.

In Simple Terms: We collect your personal details to provide you with our services, communicate with you, and improve what we offer. We also ensure your information is secure.

4. How We Use Information

We use the collected Personal Information in furtherance of our legitimate interests in operating our Service. More specifically, we use the information:

To provide, update, maintain, and protect our Service and business: This includes the use of Personal Information to support the delivery of the Service, prevent or address service errors, security or technical issues, and analyze and monitor usage, trends, and other activities.

These may include updates about changes in our Service, important Service-related notices (such as security and fraud alerts), and promotional communications about new product features or news from Lawfully. These communications are considered part of the Service, and you may not opt out of them.

For billing, account management, and other administrative matters: We may use your Personal Information to manage your account, handle invoicing, track billing and payments, and for other administrative purposes.

To investigate and help prevent security issues and abuse: We use Personal Information to detect, prevent, and respond to security threats, fraud, and abuse.

Impact of Data Sharing on Others: If you share Personal Information that includes genetic or family history information, it’s important to consider that this data could have implications for others, particularly family members who share your genetic makeup. The sharing of such information may inadvertently reveal sensitive details about your relatives, which could affect their privacy. We recommend carefully considering the potential impact on others before sharing any genetic or family history information. We handle all shared information with the utmost care, but once shared, the effects on others cannot be fully controlled or predicted.

Use of Aggregated or De-identified Data: If the Personal Information is aggregated or de-identified so that it is no longer reasonably associated with an identified or identifiable natural person, we may use it for any business purpose.

In Simple Terms: Your data helps us operate our service, comply with legal requirements, communicate with you, and improve our offerings.

5. Do Not Track Disclosure

You can enable or disable DNT by visiting the Preferences or Settings page of your web browser. Lawfully does not respond to DNT signals from web browsers.

In Simple Terms: We don’t respond to “Do Not Track” signals from web browsers, so if you have that feature turned on, it won’t change how our site operates.

Please note: while we encourage Legal Service Providers to use the Service responsibly, we have no control over, and cannot guarantee the availability of, any Legal Service Provider at any particular time. We will not be liable for canceled or otherwise unfulfilled appointments, or any loss resulting therefrom, or for any other loss resulting or arising from, or related to, the use of the Service whatsoever.

We do not sell email addresses to third parties, including email addresses or any other data, whether for monetary gain or any other purpose. However, we may share your Personal Information with our affiliates to customize or display our advertising, in a manner that complies with this privacy policy.

Third-Party Use and Disclosure:

We explicitly prohibit third-party service providers, including our marketing and advertising partners, from using or disclosing your Personal Information, including any de-identified, anonymized, or pseudonymized data, for any purpose other than performing the specific tasks we have engaged them to carry out on our behalf. Additionally, such use or disclosure is strictly prohibited without your active consent. All third-party service providers are bound to the same terms and conditions outlined in this privacy policy, ensuring that your data is handled with the same level of care and protection as if it were managed directly by us.

In Simple Terms: We work with third-party companies to help us provide our service. They can only use your information to perform tasks on our behalf, and they must keep it secure.

7. How Long We Retain Your Information

If your account becomes dormant (i.e., if you have not logged in or interacted with the Service for an extended period), we will continue to retain your Personal Information for two years to allow you to reactivate your account without losing your data.

After two years of dormancy, if you do not reactivate your account, we may deactivate your account and your Personal Information may be archived. Archived information will be retained only as long as necessary to comply with our legal obligations, resolve disputes, collect fees owed, prevent fraud, enforce the agreement, or as otherwise permitted or required by applicable law, rule, or regulation.

After the retention period has expired, we will delete your Personal Information or retain it in a de-identified or aggregated form that no longer identifies you personally. This ensures that even if your account has been inactive for some time, your data is handled with care and security.
