All the work for nothing🥲🥲🥲
That seems to be the end. Im in the EB3 process and we where about to file the PERM but once i saw that pd is now 2020 its basicly useless to proceed. The last month was already bad but now it moved back another 2 years. Even when i have to wait another 8 month till i have my PERM there is no chance that USCIS can catch up a backlog of over 3 years in that time. But i also know im not going back to Germany, i rather hide myself in the mountains.😅 EB3 row has been current for the past 3 years so how can there be a backlog of over 3 years now within 1 month. I dont get that and how much impact can the new fiscal year have.

I wouldn't be so pessimistic. File your PERM , there could be a chance that the new fiscal year will change the dates... you never know 🤷

Im sure the new fy will bring changes but the question is if it can catch up a 3 year backlog. We will see.

My friend, this situation already happened in 2019 and 2020. It had also gone back 2 years and in October 2019/2020 the EB3 became current for ROW. It will be the same this year.

file for PERM, in October it will reset and progress significantly as the guy in the above comment said

There is a reason behind the retrogression on August. It reminds officer not to approve anything after 2012 because all visa will go beyond the limits set by law. I suggest you continue with your PERM because you never know what might happen in Oct. and as far as historical data is concern this trend is pretty normal.

Whilst I'm shocked too by how much the retrogression is, looking at the positive, it kind of shows USCIS is trying to process applications in order. if you go on Reddit you'll find a few ppl who filed in 2020 frustrated to not have received approval when ppl filing in 2023 are getting theirs. So on the positive for those ppl, they at least know their place in the queue won't be jumped (hopefully)

I found this too: In 2020, EB3 retrogressed by 3 years and 2 months. The retrogression happened in March, and then became current in October of that year. In 2019, it retrogressed by 3 years and 1 month. The retrogression happened in August and became current in October of that year.

yes there's hope. hope you don't withdraw from PERM. though I feel PERM is one of the most painful stages cuz there is PWD + Recruiting+PERM. so please don't delay on starting that process if you can

@Gnu Wu Im almost done with PERM, pwd+recruitement is over now we would file the labor certification. i just keep going, my visa expires mid november and then my lawyer files cos to b2 but only if the new fiscal year starts with bein eb3 current otherwise i just marry my girlfriend. im not going back to Germany,no way.

@Gnu Wu even worse, that was really a hit in the face. Im still waiting for my PERM but now it doesnt even matter anymore, even with my perm and then a I140 i still have then as much as i have now, NOTHING. Im pissed and have no more hopes.

hang in there mate. by next yr Oct you'll definitely be able to file your 485, and with that EAD, AP, and 180 day portability. Find hobbies, bury yourself in work and time will fly by fast. you've already come so far... have you found a solution to your expiring visa?

@Gnu Wu My lawyer filed cos to b2, if approved that gives me till end May, worst case i take english language class till pd is current. Thats the only plan i have, going home is not a option,not at all.

yeah I see you're using every option you've got. I know 2 friends who I believe worked full time jobs and also stayed in the USA through student visas to buy time for their other paperwork to align

@Gnu Wu With the new bad news from the January bulletin and still a 18 month backlog im not even sure anymore what to do. I just started dating and i might just get married,everything else is bullshit.

Actually, some have seen the VB as good news. The expectation is that by September the PD will be Feb 2023 (which is the current filing date). So by the time they release the VB for the next fiscal yr, in just 9 months from now, you'll be filing your AOS and will be current. try to hang in there in the meantime. Time will fly by fast between now and then!

@Gnu Wu I got married 8 days ago, collected some very strong evidence and hired a lawyer, no more bs. I was running out of time, i had only time till May and my pd was 8/23. DOL is still far away from processing PERMs from August plus the backlog on EB3 itself.
