K-1 Visa with Overstay
Hello everyone!
I would really appreciate some help with this. My fiance (from Colombia) lived in Panama for a year visiting his family. He never worked illegally or got into any trouble - he overstayed the allowed 6 months for tourist visas and paid the fine at the border for overstaying to 'clear' it and allow him to travel freely to Panama. He has been back several times since then. This was in 2018. Will this be an issue at all at the interview?
Continuous Residence requirement N400
Hi everyone. I'm finding it hard to fully understand the 5 years of continuous residence requirement for applying for citizenship (N400) and was wondering if anyone has had a similar experience to me...
- Sep2014 = Obtained my green card but was living in the UK (I was in college until 2016 and then worked for 2 years) and returned to the US at least every 6 months for 1-2 weeks to visit my parents (and maintain my LPR status).
- Mar2019 = Returned to live in the US full-time.
I've met the physical presence requirement and >5 years as an LPR. But I'm unsure about the continuous residence requirement now... Anyone gone through anything similar?
EAD lost, Can I work with replacement EAD application receipt?
My EAD is lost by USPS. I never received my EAD neither have copy of EAD.I got my I-765 and I-131 approval notice. Now I have to file for replacement EAD. So Can I work using the replacement EAD application receipt for 90 days?
There is one rule 8 c.f.r. 274.a.2(b)(1)(vi)
which allows employees to work 90 days with replacement card receipt.
Anybody familiar with this rule or same situation?
recieve rfe for 3 months but no response from uscis until now
hi everyone we recieve rfe from our k1 visa last August and we submitted the rfe on the same month but its been 3 months since we submitted we haven't heard anything from them we've tried the inquiry but they just send us the generic messages saying can't can't provide the date they will do the approval. is there anything we can do?

In short, wonderful news for E- and L- spouses who no longer require an EAD to work! 🥲
there’s also legislation that enables H4 EAD auto extension for those who have a valid i94.
I hope this helps - I was so relieved to hear the news as I had been losing hope!
