No, it’s just sitting in Nebraska.
- Does that mean it has been reviewed?
No, your case is currently standing at their office, that’s all.
- Do you have any information about the waiting time I'm experiencing?
No, there’s nothing available. However, in February, you might be able to file a request for an inquiry if you're still waiting. Just keep in mind that the waiting time could increase.

Approved I-140, but want to pursue I-130
Hi all,
i am on OPT and I have an approved I-140 and rightnow waiting for my priority date to become current and also was planning to get married soon.
I have an emergency and need to travel to my home country. if I travel, I won’t be able to come back because I don’t have stamping.
if I get married and get the travel document and later on, withdraw my I-130 application to pursue I-140 route. would that be a red flag?
also, I never intended to get a gc through marriage so me and my gf were not working on gathering/accumulating documents. How do I work around with that?
PS: just withdrawing the application, not the marriage.

Wishing everyone the best, especially those Oct/Nov/Dec-2023 filers without Premium Processing, as we approach the 12th month, which is now the average waiting time for 80% of cases to be reviewed.
(IMO; Additional delays are likely due to the massive influx of applications and prioritization of cases that are current.)
•Today marks 366 days since I submitted my I-140 application and
• 330 days since my last status update to “Case is being actively reviewed…”.
Let’s stay positive and see what the future holds as we continue waiting patiently, some cases are passing ~450 days already.

EB1A (PP) RFE from Nebraska, asking to send response to Texas?
I-140 EB1A petition submitted a month ago (premium processing, case starts with IOE, living abroad, consular processing).
Originally sent to the National Benefits Center in Lee's Summit.
Within 5 business days, got a kitchen sink RFE from the Nebraska Service Center.
The RFE says that the response should be sent via mail to the Texas service center.
Could it be that the officer decided to send the RFE and then transfer the case to Texas? Or is it common as a way to just distribute the load of document scanning? I wouldn't mind getting a different officer reviewing my RFE response lol, this one is notorious

Does anyone know what is the average timeline for the response of an I-140 application for a Rest of the World or current PD countries in a regular process?
I know the USCIS page says 12-14 months but also says that if they have visas available (current PD) the cases are kind of “faster” because they give them priority.

PD September 2012, I140 was approved in 2013.
I was hoping that my date will get current in the next bulletin, but I got this instead -
"On September 3, 2024, we mailed you a notice explaining our intent to revoke our earlier approval of your case, Receipt Number LIN**********. The notice explains what we will do. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice before September 17, 2024, visit the USCIS Contact Center webpage"
I haven't received the actual notice in the mailbox yet.
I have the same employer since 2010.
Can anyone provide any pointers on what could be the reason and what should be next course of action?

Wishing success to all, particularly those with October-December 2023 cases filed without Premium Processing.
