Why is i140 denial rate too high in Lawfully premium stat?
My case is i140 based on PERM and public USCIS data shows the denial rate of EB2 I140 with PERM is just 1-2% during FY2025 Q1-3.
But on Lawfully premium analysis, it is much bigger.
Anyone knows What is the difference?
Lawfully does not distinguish i140 perm and NIW?

My PD is on 1st March 2024. RFE responded on 28th October 2024. Then 45 days ago they updated status to Actively reviewing. Do you have any idea how long it will take to get the decision?

My RFE response date is 10 October 2024. Recently my status got updated to actively reviewing on 10th July.
When do you think I should expect decision?
I heard that if they got late more than 2 weeks to make decision it’s most likely denial.

What I’ve learned (Personal Experience)
First, I want to extend my gratitude to the entire community for all the support and for sharing in the joy of our approvals, as well as navigating the various challenges we face throughout this process.
BEFORE:
Looking back to when I started in March 2023, I realize I spent too much time trying to strengthen my case, which ultimately delayed my submission until November 2023. At that time, I recommended against pursuing the Priority Process (PP) since it didn’t seem necessary and advised everyone to take the time needed to build their case thoroughly.
NOW:
However, now I strongly encourage each of you to act as quickly as possible. Secure the best LAWYER you can find (especially if you're unsure, like I was) and absolutely go for the Priority Process! This isn’t just about the process itself, or a “peace of mind”; it’s about ensuring you position yourself effectively in line. If any issues arise, you’ll want to be able to resolve them FAST and get back in line.
DONT WASTE YOUR TIME!

For those asking why we are concerned about this and considering a priority processing (PP) even when we are not current, it's important to clarify our perspective. Our primary concern is the possibility of receiving a Request for Evidence (RFE) or another issue, and we want to secure a priority date (PD) as quickly as possible. This way, we can take action and address any problems that may arise.
•So NO! it has nothing to do with being “CURRENT”.

I’ve been reflecting on something lately and wanted to share my thoughts. I’m starting to consider applying for Premium Processing (PP), but I keep asking myself—why? • I’m not current, and realistically, I probably won’t be anytime soon (2026-2027).
Still, I’m beginning to think it might be a good idea to have my case processed sooner, especially BEFORE any changes or new regulations are introduced by the incoming administration.
I understand that systemic changes take time, but let’s not forget that these agencies often operate in their own world. Historically, they’ve made decisions based on discretion and the priorities of their officers, so there’s always some unpredictability involved.
On the flip side, some lawyer friends have advised against this approach, pointing out potential downsides. For instance, they suggest it could lead to a
• Request for Evidence (RFE), possibly as a way to buy more time since the system is overwhelmed.
• Worse yet, an RFE could escalate the case to higher-level officers, who are known for stricter reviews and higher denial rates.
Despite these concerns, I find myself leaning more and more toward applying for PP. I’ve even started saving up to make it possible. It might not be a perfect plan, but it feels like the right step for me right now.
