⚠️ How to respond to RFE with no new evidence? (VAWA I-360)
I hope I can summarize this as briefly as possible. My attorney just forwarded me the RFE letter from USCIS. According to this, there's very little evidence about my marriage and that I was abused. The RFE might have been triggered because my attorney requested an expedite for my EAD (work authorization). I'm currently on a leave of absence from work. My VAWA case was submitted sometime in January 2020. Here are some bullet points from the RFE: • "You did not submit sufficient evidence to establish your eligibility under the self-petitioning provisions of the Violence Against Women Act" • USCIS notes that Marriage certificate and restraining order was submitted "however, it does not provide evidence that marriage was entered in good faith" • Joint tax return from the past 4 years were submitted but apparently there's no evidence that tax return was filed with the IRS 🤷🏻‍♂️ • Requesting more evidence such as joint lease, rental agreement, insurance policies, utility, bank statement etc., and more evidence for extreme cruelty and battery. In the past, we lived for about 3 years at/with her parents so there was no rent agreement or utility bills. I did submit a lot of bank statements, car insurance, joint bank account, internet provider etc. For the restraining oder I did describe the abuse back then at court to get the TRO. I had photo evidence of my injury. Overall the marriage has been very messy and I tried to get as much evidence as possible but it was very difficult since my wife had most of the documents at her place. Now my attorney says that "we have some evidence that we can use". But is that enough? I've moved on long time from my past but every time I receive such a notice from the USCIS it always scares me and all I have is deportation in my head. Finally it’s my turn to give back to this community 🙏 The posts and comments here were very helpful in our process to expedite EAD. Sharing our experience in case it can be helpful to others. - July 6: called USCIS at 8am EST at 8003755283, said infopass, and spoke to an agent to request an expedite based on a pending job offer and financial loss category. Was given a referral number starting with T1B1 (the referral doesn’t seem to be helpful because there’s no way to track the request. Never got a confirmation that the request was created). If you don’t call at 8am, it’s fine too, just keep in mind the wait is long. - July 11: used the online Emma chat to follow up on my request. This was the only time we could manage to get in queue (typed infopass until getting in queue) so preferred to call subsequent times. - July 15: called to follow up and also sent a message through USCIS online account (never got any response through the online account). - July 20: called again and put a second request, got a new referral number also starting with T1B1. - July 22: got an email from USCIS asking to fax supporting documents to a number. Same day faxed all of the documents. They only asked to fax job offer letter, but we included others: Cover letter explaining our situation and noting the team at NBC to address the attention to, a copy of USCIS email, job offer letter, doctor’s notes, medical bills, tuition bills, rent and electricity bills. - July 25: noticed something looked different for my I-765 case on my online account in the morning (there’s a blue section on top left saying concurrent filing). Case approved in the afternoon. Hope this helps people waiting for their news and best of wishes to the community. #ead #expedite
