EB1-A (Extraordinary Ability in Optometry and Ophthalmology) After RFE
Sharing this to encourage anyone who is waiting on his/her case that there is always light at the end of the tunnel.
Initially I was torn between EB1-A or EB2-NIW but I chose the former given time constraint. On September 30, 2024, I filed Form I-140 with Premium Processing with documentary evidence under the following regulatory areas:
1. Judge of the work of others
2. Authorship of scholarly articles
2. Original and significant contributions
4. Membership of distinguished organizations
5. Serving in a leading or critical role
6. Receipt of lesser national/international award.
On October 15, 2024, I received an RFE for areas #3-6. The response to RFE was sent on January 14, 2025 and just today, my case was approved. This is a great relief because my STEM OPT/ employment authorization is set to expire in just 4 days (February 3, 2025). I will be adjusting my status ASAP since PD is current for my country. I'm most grateful to God Almighty for showing me mercy.🙏
hii, i wanna ask some questions
i've been seeing sept approvals and im truly happy for them but there's also some people that haven't get approved even when they filed earlier, i dont get it, is it because they don't have enough evidence, their case is complicated, missing documents, backlogs or other things.

Vawa Alex Padilla Senator Inquiry Request
hi guys, has anyone ever asked Senator Padilla in California to raise an inquiry on your case? how did it go, how fast was their response? I emailed them for inquiry help a month ago and never got a reply. Does senator usually respond to your email and give you updates before and after contacting USCIS? My attorney has been lying to me and saying that he already submitted some inquiries and wrote a few letters but when I called the USCIS, there was absolutely no inquiry on my record. I tried to do inquiry myself but USCIS didn't even bother because I'm not attorney. My attorney and his law firm partner decided to ghost me for the past few months. With all the immigration changes happening, I dont have any more time to lose. I really want to move forward since my case is out of processing time.
How much longer?
I filed for my husband on January 8th 2024 and it’s now been over a year and it still says Activly viewing case? It’s an I-130 through the National Benefits? Any idea on how long we have left?? We have 2 children and have been married since 2019? We just filed last year bc we finally had the money to do it. We used a lawyer. Anyone know how much longer an estimate or anything please!?
Over a year waiting for I-130?
I filed for my husband on January 8th 2024 and it’s now been over a year and it still says Activly viewing case? It’s an I-130 through the National Benefits? Any idea on how long we have left? He’s lived here since he was 14. No he or I didn’t know about the DACA program until it was too late. We have 2 kids and have been married since 2019? Anyone else have a similar situation with the I-130 through national benefits??
