Kbb timeline … still waiting
Hoping to get scheduled for interview soon. Was placed in deportation, Judge dismissed case and file sent to USCIS Milwaukee. Called USCIS in Oct and said they have my file and are reviewing. Priority date is Jan 31, 2020. Recently renewed EAD in May 2021. I know my case is out of the norm since it was a straight forward case until placed in deportation that pushed my case backwards for 17months. Still hopeful for a great outcome now that USCIS can adjudicate on my case.
Visa extension
Hi, I want you to help me, I came to USA few months ago for 1 month just to help my mom to go to a clinic to verify why her left leg was hurting, they found that a bladder cancer had made metatasis in the left bone, seeing the situation I decided to change my return to my country for 1 month again, the doctors decided to give her quimiotherapy, and she is in this process, they say treatment will take a long time, my concern is, my stay is about to expire, she is resident, but I am a visitor, if I file an extension to USCIS, explaining the truth, that I am the only one that can be with her helping her in averything, as she cannot walk, it won’t be any issue, a visitor can ask for an extension to take care of her mother because of a cancer?… with this kind of Visa USCIS can accept an extension?…. thank you for your help in advance!…

Correction of Parents name in Indian passport, before filling I-485
Hello,
There is an issue with the Parents name for my wife passport. Her fathers name also shows the first name of her grandfather and her mother name contains name of the father. Her passport was made when she was minor and I guess in the 80s it was something that made them to add it as guardian.
Now the challenge is the birth certificate have the correct names of the parents without the additional names as mentioned above and there is a conflict with parents name on passport with birth certificate.
Do anyone know if we can correct the parents name in the passport here in the Indian embassy. What kind of formalities we need to go through. approx time frame. Or any other alternative.
We can’t file for Change of status (I-485) unless we know the right steps else might get into a complex situations with RFE
would highly appreciate some help here
How To: EXPEDITE REQUEST
Below is how to submit an expedite request from my own experience. it's lengthy, but I've included every steps that I took when I submitted mine last month. Here it is:
- Call USCIS: +1-800-375-5283 , and say, "expedite request". Call between 8am and 8pm ET from Monday to Friday. 8am is better as the wait is shorter to non existent.
- Once speaking to a live agent, explain your situation. They'll ask you a bunch of questions to identify yourself, so get your I-797 ready as you will need it for the answers.
- After the call, gather all the evidences that you have to prove your claims because if your request is then passed to a USCIS officer for review, they might send you an email to request those documents and with information on how to send them.
- Get on this website to find who your representative is: https://www.house.gov/representatives/find-your-representative
- Once you have that information, go on Google or any search engine of your choice and type, "how to contact (representative's name)". For instance if your representative's name is ABC XYZ, Then you will type, "how to contact ABC XYZ". You should then find the website of their home state office, where you'll also find their email address and phone number for the office. You should also find information on how to get in touch with them if you need them to reach any US agency on your behalf, along with documents that you will need to sign (by hand) and send along with all your supporting documents. You should find all that information on their website.
- Gather the documents to sign, print them, fill them out, and scan. Then, in an email, attach the signed document(s) with all your supporting documents for the expedite request. You may also type in an email explaining the situation and pleading with the representative to assist you. Keyword: plead, not beg. It is worth including that you submitted a request already and insert your request number that USCIS gave you, to demonstrate the urgency of your situation.
- Once you sent that email, call them to make sure that they have received the email. You will be speaking to one of the representative's assistants. Introduce yourself, tell them why you're calling (the expedite request), and then add that you just submitted supporting documents and you want to make sure they've received the email. And also ask that they check the documents to make sure you have sent everything they need. They will tell you on the spot if they have everything or if something is missing. Keep this conversation cordial but don't kiss their shoes either. I mean, be friendly and not beggy or desperate, even if you are desperate. (We file expedite requests because we are desperate, and that's the truth). Listen to what the assistant tells you and go from there.
At this point you will have 2 requests submitted together with USCIS. From there, you will just have to wait and see what happens. USCIS will contact you, whether it is to request more documents from you, or let you know the decision they've made on your request: approval means your EAD will be approved too, usually in the same day. Denial means that your EAD will be processed/approved when it will be its turn in the line.
Please, keep in mind that expedite requests are reviewed on a case-by-case basis, and the USCIS officer who reviews each request make decisions at their own discretion. That means that an expedite request can be very compelling and still be denied, whether it was sent by you or your representative.
Good luck. 🙂
