Correction of Parents name in Indian passport, before filling I-485
Hello, There is an issue with the Parents name for my wife passport. Her fathers name also shows the first name of her grandfather and her mother name contains name of the father. Her passport was made when she was minor and I guess in the 80s it was something that made them to add it as guardian. Now the challenge is the birth certificate have the correct names of the parents without the additional names as mentioned above and there is a conflict with parents name on passport with birth certificate. Do anyone know if we can correct the parents name in the passport here in the Indian embassy. What kind of formalities we need to go through. approx time frame. Or any other alternative. We can’t file for Change of status (I-485) unless we know the right steps else might get into a complex situations with RFE would highly appreciate some help here

In my own opinion, parent's name are not really relevant when filing an AOS. You just have to put whatever name is correct... in this case it's the birth Certificate... and at the end of the form, where there is "additional information" you will just explain the mistake on the corresponding number. You will be ok.

my husband’s mom name is spelt differently by one letter on his birth certificate, and my lawyer said just go with the name that’s on the birth certificate. when you have the interview just explain to the officer if asked.

Honestly, I think you should get the name corrected on the Passport. You can call the Indian Embassy or check their website. My lawyer advised me to leave no stone unturned. We all know how notorious USCIS is. Also, if you can, Please consult a Lawyer on how/what to add to "Additional Information" section.

so I was adopted from India to Canada at a young age. I never had a birth cert. Only my landing papers in Canada which I submitted to uscis. our lawyer explained why I didn’t have a birth certificate and uscis accepted the explanation and no birth cert was needed. Next, for my parents names on passport… there wasn’t even a last name listed lol uscis is aware of the messy Indian system so if you explain it, you’ll be ok

That's what I'm saying... But first just explain the situation at the end of form, like that the officer will know in advance the problem and during your interview you will explain better. Don't just surprise the officer. You will be good. GO FOR WHAT IS ON YOUR BIRTH CERTIFICATE.

@chan Bala - based on my discussion with my lawyers they suggested to go with whatever is there in the birth certificate. also for any issues I kept an affidavit from the parents in case any RFE response is required. along with. a Govt ID but like lawyer said go with birth certificate detials
