I-140 (premium processing) approved on 4/14/2023
I-485 transferred to NBC on 4/24 , biometrics completed on 5/11. Approved on 7/7/2023.
My status was “Case was updated to show fingerprints were taken” until it got approved today.
Important to note as well that I did not receive any update on my EAD and I-131.

Later after few years PD will become currnet. Can we file i-485 from india with consular processing..even without having valid l1a/h1b direct for GC

PD: August 2020
an overstayed B1/B2 beneficiary, married to an American citizen whom I divorced in December 2021during the process after filling I-485, i-765 and I-130 for I and my Kids under 21 which was abandoned because we couldn't provide the RFE and was denied for myself and kids. Although EAD was give to I and my 2 kids.
The marriage was very manipulative and secretive as my so called husband never told me he was already married once with 16 kids and 2 other girlfriends. I could not sleep, I felt trapped. Every time I upset him or confronted his infidelity, he threatened to withdraw the case. I felt mentally exhausted, psychologically and emotionally abused USCIS requested that we appear on August, 2021 for an interview about our petition for filling but we were unable to appear as requested and provide necessary bona fide relationship.
please I need your advise on how to go about it..
am now ready to reopen the case.

RFE is for medical and they requested a police certificate and affidavit since they were unable to read my fingerprints after doing biometrics twice. Earlier today, I received an email that they took an action on my case and then it just showed that they updated it to response received. I thought of checking it before dinner time, and I found this! Now just waiting for the letter and the card to come in the mail.

It was dropped off early this morning and signed for. But it said ‘dropped off at mailroom/reception of USIS’. So kinda nervous it was delivered to the wrong place. My deadline for submitting this response is July 11.

upgrade to EB1
I have an approved I-140 (EB2NIW) with a PD on November 2022. I filed my I-485 concurrently and it is at Los Angeles FO now. I haven’t received a biometric appointment, EAD or travel parole yet. due to EB2NIW retrogression, I am considering to apply for EB1 I-140 now and upgrade my I-485 to claim November 2022 PD. Have anyone succeeded in pursuing this path (upgrade EB2 PD to EB1) recently? My lawyer told me that my profile would qualify for EB1 but of course I have to wait for EB1 I-140 approval so I don’t know if it would actually speed up the process. What do you guys think?
