I-485 got approved after denial
I am posting here the story so people with the similar situations get some idea. I got my green card approved on June 2022. I got married before my green card got approved. In October 2023, I applied I-485 for my wife. In February, she got her EAD card. She accepted her graduate school admission based on the EAD card. Surprisingly, a few days later we got her I-485 denial notice mentioning that she didn’t submit any i-140. However, we actually did submit my approved i-140. More on that, the denial letter mentioned they sent us RFE and we responded, but our response was bot satisfactory. Interestingly, neither me nor our lawyer received any RFE. So sending responses was out of question. We immediately applied for I-290B, motion to reopen. We reached out to USCIS severap times requesting to expedite the process as my wife needs to confirm her admission in graduate school. But USCIS refused to expedite. Then our lawyer raised an ombudsman’s office inquiry. After one moth, they reached out to us and mentioned they communicated with USCIS to look at the issue. On May 08, USCIS reopened the case and approved our I-485 in the same day. Our lawyer from the Chen Immigration was very proactive and made our life easier. We are grateful to him.
