I want to see if I can apply for my i485 or if I only can do the consular processing
My wife is a green card holder we have a 2y daughter and I would like to know if we can apply for my adjustment of status in the USA, because this way I could also apply for my work permit, I read the i485 instructions and it doesn't say anything about a green card holder not being able to use the form on behalf of somebody.
But my lawyer said that the only way for me would be doing the consular processing (601A)
Can somebody please help me out with this? Thank you!!

EAD Eligibility for ASYLUM SEEKERS
Hello my fellow immigrants. This post is just a reminder that there are new rules in place for asylum seekers who want to apply for an EAD, Form I-765. These rules have been in effect since August 21, 2020. I have included the link for them in the comments for easy access. The rules apply to every asylum applicants filing for an EAD after August 21, 2020. This means that if your EAD application was processed a certain and possibly even faster way before that date, it is no longer the case.
Some but not all general key points:
- 1-year waiting period before filling for initial C8-EAD for some applicants
- Longer processing times for C8-EAD, including initial C8-EAD
- C8-EAD validity length is decided at the discretion of USCIS, but cannot exceed 2 years.
- Certain convictions in the US will bar asylum seekers from receiving an EAD (this includes traffic convictions and domestic violence)
- Asylum seekers who filed the asylum petition more than 1 year after entry to the US may not qualify for EAD.
The list is long and can be found in the link from the comments section. Some rules are not strictly enforced yet but it is a matter of time until they are. Also, now USCIS has full discretion of denying EAD applications unlike before August 21, 2021. This means that you may or not receive an REF notice for C8-EAD applications, but instead a denial because of missing documents. So, if you're an asylum seeker, I would urge you to get an immigration lawyer. The choice is still yours, of course, but on your own, your chances of immigratting in the US via asylum and getting a C8-EAD are even more complicated now and possibly even slimmer depending on your situation.
In all in all, be ready to wait a LONG time for your C8-EAD to be processed, regardless of the service center.

Interview completed, case must be reviewed.
I had an interview day before yesterday. It was easy and lasted for about 10 minutes. She took a copy of our daughter’s birth certificate and gave us the white paper. A few minutes later, the cause updated to “Interview was completed, case must be reviewed.” Who got the same update? How long is the waiting period?

it’s been almost 7 months & it still has NEVER been under actively reviewed. should we be concerned? I have never seen someone from TSC not be under actively reviewed after 7 months. this gives me the feeling that they lost it

expedite request denied
I called and chat with Emma to try to expedite my i485 and i765. they denied the request and said wait for further communication from the service center. what should I do? my opt will expire on April, should I apply for extension of my stem opt on March, or try again for expedite?

I had to do my medical exam twice because of this 60-day rule…even though my documents were received within the time limit. Lol!

Case is ready to be scheduled for an interview for second time
Back on July 16th 2021 I got a notification that my case is ready to be scheduled for an interview and still waiting for it and today December 9 I got the same notice that my case is ready to be scheduled for an interview is the second time, does this mean that is gonna be scheduled soon??? Someone with the same experience?
I also got an email today that uscis has taken an action on my case but there's nothing when I check.
DWI & I485 marriage-based application
Hello everyone,
I was wondering if anyone has any experience or knows anyone that has been approved for a green card (I485 marriage-based) while having a DWI on their record???
I had my interview a couple weeks ago, my lawyer felt the interview went incredibly great, the officer told us she had no doubt we were married, in love & she was going to approve my I-130 but she was going to need more evidence regarding my arrest/DWI.
I'm very nervous.
