expedite request denied
I called and chat with Emma to try to expedite my i485 and i765. they denied the request and said wait for further communication from the service center. what should I do? my opt will expire on April, should I apply for extension of my stem opt on March, or try again for expedite?

Syed - I would suggest you apply for the stem OPT extension if you have that option.

hey, I don’t think you can apply for stem extensions. your 485 application showed your immigration intention which makes you disqualified for F1 benefits. (I guess)

Ashkan - that's a good point, but Syed's F1 status is still valid until withdrawn or expired. he can pursue both applications until one comes through, at which point, Syed will have to forfeit the other one as one can only have 1 status at a time. in this case, the I-485 is still pending. that means it can be denied or granted. Syed has a valid F1 status and can extend that status by extending the STEM OPT. doing so would allow him to work/continue working while he waits for the I-485 and I-765 on that new status. until that happens, Syed is still on F1 status. 🙂
Syed - you're welcome. but it's best to consult with an immigration lawyer too, just to be sure and not hurt your chances at immigration.

@lilo I’m going to try congresswoman to make an expedite request. which one should I expedite, my i485 or i765? or I can do both? and one thing which way would be better to contact a congressman office, by requesting through their service form, email or by phone? thank you.

Syed - you're welcome. leave your I-485 alone. it's a long process and you're too early to do anything with it. so, if you try to expedite it now, you will be denied. you also have no basis for expediting your EAD under that category because again, you're too early in that process. immigratting in the US is a slow process, and it doesn't go add you want but rather add USCIS dictates. so you have to be very patient. advice for you is to file for the OPT extension instead, as that's currently your best option, and let the I-485 and I-765 under that category run their course.
the other option is to let your F1 EAD expire without filing for the extension and wait to receive the EAD under the I-485. but you will risk to become ineligible for employment untill you get the new EAD.
so, the bottom line is that you currently have no basis to expedite anything.
