Prolonged I-485 and H-4 Delays—What Is the Best Way Forward?
My #EB-2 NIW priority date is October 2023. My family’s I-485 applications were received on October 24, 2025, but there has been no progress or meaningful update since then. Additionally, my dependents’ H-4 extension applications were received on June 24, 2025, and have now been pending for over 450 days. My work visa was extended as the principal applicant, but my dependents’ H-4 extensions remain pending. Everyone in our family received employment authorization except my husband. His driver’s license has expired, and because his H-4 extension and employment authorization application are still pending, he cannot work or renew his license. This prolonged uncertainty has left him deeply frustrated and depressed. The situation has also placed a significant financial and emotional burden on me because I am solely responsible for supporting our family of six. Although we have an immigration attorney, the attorney has not responded to my inquiries for approximately three months. What is the best way forward? At what point should I contact my congressional representative, submit an expedite request, contact the USCIS Ombudsman, consult another immigration attorney, or explore legal action to compel USCIS to adjudicate our cases? Has anyone experienced a similar situation? I would sincerely appreciate any advice.

EB1-A green holder family immigration (Spouse & Childern)
Hi everyone, I am an EB1 A green card holder. My I 140 was approved in March 2023, and my I 485 adjustment of status was approved in September 2023. When I filed my I 140 and I 485, I included my spouse and five children as my derivative beneficiaries. However, they were living outside the United States and did not file separate I 485 applications. I would now like to bring my spouse and children to the United States through the appropriate follow to join or consular processing process. Could anyone who has been through a similar situation please guide me on which application or petition I should file with USCIS to initiate the process? I am particularly interested in knowing whether Form I 824 is required in this situation and what the next steps would be after USCIS approval. I would greatly appreciate any guidance from people who have successfully brought their EB1 A derivative beneficiaries to the U.S. after adjusting status. Good luck to everyone waiting — we’re entering the final 7 days of FY2026, which ends Sept. 30. USCIS tracks completions and adjudication performance by fiscal year, so I’m hoping we see a strong final-week push and more approvals before the year closes. One tip that helped me: if you call USCIS, don’t only ask for the public “last update.” Ask whether they can see the most recent internal timestamp or note showing when the case was handed/reassigned from one officer/person to another. In my case, the public update is FNG/re-fingerprints on July 15, but agents previously saw officer activity on July 23, and today I learned there was another internal handoff at on Sept. 10. They couldn’t tell me what the handoff specifically meant, but at least it shows the case has been moving internally even when the public tracker doesn’t change. March 2026 I-130 Filers — Anyone Approved Yet?
Hi everyone! 🇺🇸🇵🇭 Looking for timelines from other U.S. citizen spouses filing an I-130 for their Filipino spouse. My husband is a U.S. citizen petitioner, and I’m the beneficiary here in the Philippines. Our I-130 was received on March 8, 2026, and it’s currently at the Texas Service Center (TSC). Our receipt starts with IOE. We’ve been waiting for over 6 months with no RFE or approval yet. For those who had a similar USC → Filipino spouse case, especially with TSC: • How long did your I-130 take to get approved? • Was your timeline similar to ours? • Is there anything we can do to help speed it up, or is waiting the only option? Is $7,000 reasonable for a WOM/Mandamus case for two people?
I’m trying to decide whether to file a Writ of Mandamus (WOM) for my pending I-485, and I would really appreciate hearing from people who have recently gone through this. I filed my I-485 on November 20, 2024, and I still have no decision or meaningful update. I had already waited around 4 years after my asylum interview before finally receiving my asylum approval. After the approval, my wife and I filed our I-485 applications, and now we have been waiting again. I recently called my immigration lawyer because I feel like I have been waiting for a very long time. The lawyer offered to file WOM cases for both me and my wife for $7,000 total, including fees. However, the lawyer also told me that USCIS currently shows approximately 34 months for the processing time, so they believe there is a low chance of success if we file now. They basically said the court may consider the cases to still be within normal processing time. For people who have experience with WOM/mandamus: * Is $7,000 total for two people a reasonable attorney fee? * Does the fact that USCIS processing time is currently around 34 months make a WOM significantly weaker? * If my I-485 was filed in November 2024, does the fact that the posted processing time was much shorter when I filed matter? * Has anyone filed a mandamus in District of Massachusetts while their case was still technically within USCIS’s current posted processing time? * Did your attorney charge a similar amount? * Did filing the WOM actually result in USCIS taking action? I’m not asking anyone to tell me what I should do. I’m mainly trying to understand whether $7,000 for two cases is a normal/reasonable fee and how much the current 34-month processing time matters in a case like mine. Thank you.
