Sharing my greencard journey (migrating my employer sponsorship to spousal USC sponsorship)
I did not see many people with my journey so sharing here in case it's helpful for anyone. Context: I am an Indian citizen and applied for my employee I-485 in 2020 when my dates became current for filing (priority date : Oct 2014 EB2), my application was at NBC. However, no movement to the dates since 2020 (retrograded to 2012). Meanwhile, I also got married to a US citizen in 2022 and the lawyers advised that I apply for my 1-130 with my employee I-485 application rather than filing a fresh I-485 (done Dec 5th 2022). My 1-130 got approved Oct 2023, but no movement on I- 485. I was getting restless and was going to file a fresh 1485 in the new year consulted a few other lawyers and all of them suggested I should have filed for a fresh i-485 rather than used my employers existing 1-485). We did a final last attempt in Dec 2023 and filed a letter to USCIS making the request to change the underlying basis to the approved 1130 and providing them with all of the relevant information. I also reached out to my congresswoman and the representative was super helpful and they reached out to USCIS for my case. Within 10 days of contacting the representative, my case got approved with conditional greencard! I applied in 2014 and finally got my greencard in 2023, very grateful for this subreddit for answering all my questions and saving $$ in filing a fresh i485. Good luck to all of the folks applying.
