Need advice on tax filing
Hello family, I have a really important question and I’m a bit unsure about what to do. My husband has quite a bit of debt, and we got married in February last year. We were thinking about filing our taxes jointly and using that as additional evidence. But I’m wondering, if he files as married but separately, would that look questionable to a USCIS officer? Are there any disadvantages to filing married separately instead of jointly? I’d really appreciate your thoughts.
I-751 ROC waiver
Hi People, I want to share my experience about my interview for remove condition (751) as waiver
interview was at 8:00 am and they called me at 8:40
she started asking me my full name, DOB, my ex wife’s full name and DOB, asked when we got married, where we lived, what was the reason of the divorce, if we have child.
most of the time she was typing on the computer. She said that she looks everything good and was going to re check something to approve the case, and told me to wait few weeks to received the new card.
I felt that my ex wife’s affidavit helped me a lot cause I felt they didn’t ask too many questions.
EB3 2nd interview after mandamus
My USCIS interview was completed a few minutes ago, and overall the experience was very positive. The interviewing officer was super friendly and professional.
During the interview, the officer asked questions mainly focused on:
• Maintenance of my F-1 status
• OPT approval and OPT employment history
• Questions related to my sponsoring employer
• Whether I am currently working
• My intention to continue working for the sponsoring employer after receiving the green card
• She reviewed my job verification letter and recent pay stubs
• Finally, she went through all the yes/no questions from Form I-485
After reviewing everything, the officer stated that everything looks fine and mentioned that I should receive a decision soon.
This was my second interview, and it took place after filing a mandamus lawsuit. My wife (derivative applicant) and I were interviewed separately.
Important note: The officer mentioned that for EB-3 cases pending for a long time, USCIS is now scheduling interviews as part of a new policy for this category.
Overall, the interview went smoothly and was straightforward.
Not Sure If EB2-NIW Is Right for You?
EB2-NIW isn’t suitable for everyone, and that’s something many people don’t hear early enough.
Before filing, it’s important to understand:
• Whether your proposed endeavor is strong enough
• If your evidence supports national interest
• What risks exist in your profile
Some people benefit from getting clarity before investing time and money.
I’ll continue sharing insights here for those navigating this process.

upgrade F2A to Ir1
My spouse has filed N-400, and expected to receive citizenship certificate around March.
I’m confused whether I should upgrade F2A to IR1 after my spouse becomes a U.S. citizen or just wait for the normal I-130 approval.
The reason I’m hesitant I’ve seen many people who requested F2A to IR1 upgrade
Their upgrade requests have been pending for 6–7 months
No approval, no movement, no meaningful update so far
So my question to experienced members In a consular case like mine, is upgrading really beneficial, or does it actually slow things down? Is it better to wait until I-130 is close to approval before requesting upgrade, or not upgrade at all?

EB3 current again - does 485 auto-switch?
PD: 11/2013. Did the EB3 downgrade and filed 485 concurrently. When EB3 retrogressed, filed TUB + Supplement J in 2021 to move the 485 to EB2, and that J was approved. EB2 later retrogressed as well. Now EB3 is current again while EB2 isn’t. Recent case update "fingerprints were reapplied" last month (second time). Do I need to file another TUB + Supplement J to switch the 485 back to EB3, or will USCIS consider it under EB3 automatically without any new filing?
