can I sue USCIS if my case has been reopened since 06/22

I130 and i485 pending for almost 5 years aos based on marriage filed in September 2018 interview on August 2019 USCIS site visit March 2020 and noid in September of 2020 I wrote a letter to them in September of 2021 and in October I received i-130 approval but also a i130/i485 denial from September 2020/2021 on same date so far in 2022 my attorney filed i290b and i130/i485 have been re opened since June of 2022 this has been too long and I want to see what I can do to get these cases adjudicated
Request an expedite and they suggest for alternative visas that may be available
Hi everyone,
In my request for an expedite, I strongly believe that my case deserves it, but NVC responded by sending me this email:
"As there is no visa number currently available, we are unable to expedite the processing of this case.
You may wish to contact the U.S. Embassy/Consulate General in Post or the U.S. Citizenship and Immigration Services (USCIS) regarding alternative visas that may be available.
Please visit https://www.usembassy.gov to find the contact information for the appropriate U.S. Embassy or Consulate General.
The individual Embassy or Consulate General's website includes contact information for visa-related inquiries".
Do you have any experience with this? Which alternative visa can I use for my case that is in the process of being processed for immigration?

Backlog of I-601A I601A cases to get focus from USCIS with HART
From the USCIS website:
https://www.uscis.gov/sites/default/files/document/notices/USCISOpenstheHumanitarianAdjustmentRemovingConditionsandTravelDocumentsHARTServiceCenter.pdf
"After a review of USCIS processing times, we deemed that the greater focus should be provided to these humanitarian-based benefits, which led to the creation of the HART (Humanitarian Adjustment Removing conditions and Travel documents) Service Center.
HART will process both digital and paper-based applications and petitions and will partner with existing service centers to support physical onsite necessities such as file exchange and administrative support.
The HART Service Center will initially focus on the following case types:
• Form I-601A, Application for Provisional Unlawful Presence Waiver;
• Bona Fide Determination (BFD) for Form I-918, Petition for U Nonimmigrant Status;
• Form I-730, Refugee/Asylee Relative Petition; and
• VAWA-based Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant."

Approval timeline PD: June 03 2022
hi all, I’ve been checking this app for 11 months. posts shared here were helpful and don’t want to delete the app before sharing my timeline.. feel free to ask any questions!
I am Colombian and British. Entered the US with tourist visa, got married (he’s a US citizen) in May 2022 and we submitted the adjustment of status package on June 3 2022 (I-130, i-485 and I-765) one day before my tourist visa stay expired. No lawyers, I did everything myself. Sent medicals with initial package.
Here’s the timeline:
June 3 2022 - USCIS received documents
July 6 2022 - Biometrics
July 6 2022 - Request of initial evidence for I-485 — asking for my husbands W2s (taxes)
July 7 2022 - RFE received (sent online) “Actively reviewing your case” in i-485
Dec 19 2022 - i-765 approval notice (EAD card)
Dec 27 2022 - EAD card delivered
May 6 2023 - new “Actively reviewing your case” in i-130. thanks to this community I knew it probably meant it had been approved. I checked the documents folder on petitioner’s account and voila — the approval letter was there.
May 7 2023 - I-485 Approved. I-130 still shows as “actively reviewing” but with the approval letter it means IM FINALLY GREENED.
My field office is Miami, FL but both approval letters came from National Benefits Center. No interview, no RFEs.
Will update once I get notified that the card is being printed and once I have it in my hands.
It feels surreal 🙏🏼 thank you God
Wish you all good news soon, and a good amount of patience and faith in the meantime.. your time will eventually come!

Hello my friends, I need help, I paid all my bills for my family's visas there are 4 of them including my wife and my three children, the file is already complete and we are waiting for the date for the interview since November in my great surprise NVC sends me a letter “for your case to continue, you need to pay one or more processing fees. Please go to https://ceac.state.gov and log in with your case number and your invoice ID number. Those numbers are in the Welcome Letter we sent you.
· The Affidavit of Support fee must be paid separately from Immigrant Visa fees.
, I call my lawyer unfortunately he does not answer my call, what can I do?
Administrative Processing with retrogression after interview in April
Hello
I had interview in April 19, the consular said it’s apporved.
And Ceac status was updated to Administrative Processing on 25 and 27th April.
However since then, there is no update until now.
Visa is not issued in April successfully.
My Priority date is Aug 2022 which is involved in Cutoff for EB3.
In this case, is my case affected by retrogression?
Is that the reason there is no updates since end of April?
Then is that okay i ask the embassy to return my passport?
Thank you.
