I130 approved 2yrs ago
Hi! I was just wondering if anyone is having the same experience as me here and wanted to ask for an advice on what to do.. I was a j1 visa holder before (2019) and my partner is a green card holder. covid happened so i decided to stay here instead of returning back home to my country. and my status was about to expire back then so i decided to adjust it from j1 to tourist and that is when my partner and I decided to get married too (2020). after we got married, we immedietly filed for my petition which is the form I130, we didn't know that we are allowed to file the I130, I131 and the EAD all at once because we only did it ourselves. so when the I130 got approved (2021), my tourist status is already expired and wasn't able to file for the EAD and I131 anymore. so we asked a lawyer for an advice and they said that the only option i got now is to either go home to my country or wait here, keep it lowkey and wait until my partner become a citizen. so my partner and I decided that I stay here. so now, my partner is going to have her citizenship interview on the 26th and we are hoping and wishing that she pass it. so, we were just wondering since she filed for my petition I-130 way back in 2020 and got approved in 2021 as a green card holder, does she need to file for my petition I-130 again as a citizen since it's been 2 years now when my I-130 got approved or we could just go on to filing my I-131 and EAD instead after she becomes a citizen? and somebody told me that I-130 expires, is that true? and how will we know if ours got expired? Thank you in advance! :)
