Concurrent Filing for Certain Religious Workers
The Department of Homeland Security (DHS) is proposing changes to the regulations governing the process of adjusting one's status to lawful permanent residence in the United States. The proposed amendments include allowing concurrent filing of a visa petition and an application for adjustment of status for certain special immigrants, such as religious workers.
It also suggests allowing the transfer of the underlying basis of a pending adjustment of status application, modifying the definition of ineligibilities for adjustment of status, changing the calculation of age under the Child Status Protection Act, and authorizing employment authorization for certain derivative beneficiaries who are waiting for immigrant visa availability and can demonstrate compelling circumstances.
The DHS also intends to amend regulations concerning temporary protected status, travel authorization, and their impact on eligibility for adjustment of status. These changes aim to reduce processing times, improve inventory data provided to partner agencies, minimize visa retrogression, and enhance the efficient use of available immigrant visas.
