I received letter about my appeal
I filed appeal in March 2023 based on denial of my case.
This is what I just received “ Counsel has requested that the matter be remanded to the Director for further consideration. Accordingly this matter is remanded to the Director for further consideration and for the entry of a new decision “
Has anyone experienced this OR do you know what’s next after this?

Follow-to-join within the US (non-consular) based on approved green card
- Spouse’s I-485 was approved last November.
- My I-485 was submitted based on spouse’s approved I-485/EB3 unskilled (instead of green card/spouse)
- Priority date is way back (2019)
-My I485 was filed early June and was approved last week (3 months). No interviews, no RFEs
So-called “following-to-join” because Spouse recently received green card and we married prior to filing the 485.
Wish everyone waiting on the priority date the best luck!

Finally approved!
After waiting nearly 6 months the game of waiting for Green Card ended up. All the praise for Almighty Allah! I am sharing some exceptional circumstances to guide future aspirants particularly those who are applying for AOS being F-1
PD: 2 March 2022,
I-485 Submitted: 31 March 2023
Fingerprint fee Received: 06 April 2023
Figerprint taken: 05 May 2023
Case Decesion: 15 September 2023
1) RFE didn’t update:
I had received one RFE for medical but it never got updated in case status. My case transferred to field office. However no change in case status and also never get updated. Finally, the decision of the case get updated after 8 days of RFE response.
2) Emergency Advance parole
Before fingerprint if you need emergency advance parole this is a critical situation. You have to call USCIS, explain your situation. They may reject your request. Chat with Emma know what USCIS action is. If you see it doesn’t work then after waiting 1 week proceed to second emergency request. I put 3 request they respond to one request. I faxed them evidence. Then after reviewing, it was got approved. Calling USCIS for emergency advance parole is better than chatting with Emma. We received it after 2 months. So don’t be too hopeful.
3) Combo card processed in expedited request:
I Asked Emergency advance parole, they gave us combo card. That was very unexpected but very fruitful experience. Specially for my wife, she switched from F-2 to AOS and started working. For F-1 my lawyer told me if you are not working in the same field as you proposed in your I-140, you are likely to deceiving. So don’t go beyond your proposed endeavor during AOS.
4) AOS or F-2:
After getting combo card it is better for F-2 to abandon his/her status and switched to AOS status. Overall risk is low.
5) Keep in touch with USCIS:
Most of the people do this. But, I am emphasising again please chat Emma or call USCIS to track your case at least once in every week. This days tracking case doesn’t work. I always see my case episode never got updated.
Being F-1 student I had a terrible risk of losing my status. My own Visa status going to get expired. Asked for expedited processing to get EAD and Advance parole. Meanwhile, I lost my mother-in-law during the processing. My Father-in-law got cancer. Lost so many near and dear persons during the journey. Luck didn’t favor me to see them one last time being my case pending. Retrogression stuck my case for 3 months. But very happy to finish this journey.
Hoping to meet with my family soon, going back in my country after four years. Thanks this wonderful community. All the best for your journey. Stay Blessed and keep paitence till the end.
I got the card today
My Social Security card came 1 week ago. Then, on the following day, the EAD status changed to "being produced" and it took 5 more days to get here.
