I-765 Employment Authorization
I applied for EAD in November 2023 and got 180days extension. I just read the below on ISCIS website:
ALERT – NEW TEMPORARY FINAL RULE INCREASES AUTOMATIC EXTENSION PERIOD FOR CERTAIN EAD RENEWAL APPLICANTS: On April 4, 2024, USCIS announced a temporary final rule (TFR) that increased the automatic extension period for employment authorization and EADs of certain EAD renewal applicants from up to 180 days to up to 540 days.
The new temporary final rule is effective on April 8, 2024. This temporary final rule will apply to EAD renewal applicants eligible to receive an automatic extension who timely and properly filed their Form I-765 applications on or after Oct. 27, 2023, if the application is still pending on April 8, 2024. The temporary final rule will also apply to EAD renewal applicants eligible to receive an automatic extension who timely and properly file their Form I-765 application on or after April 8, 2024, and on or before Sept. 30, 2025 (540 days after publication of this temporary final rule in the Federal Register.
Question: Does this mean I am eligible for the 540 days extension? or will I get a document to that effect?

yesterday i got my card so i want to confirm that can i travel outside the united states there will be ni any issues because today i went to social security office for apply my ssn they said you are showing non immigrant i don’t know why i have physical card .
please tell if anyone experienced
I-131 and I-765 after I-140 approval
My I 140 was approved in Jan 2024 and my PD is also Jan 2024 (I used premium). I submitted an AOS with 485, 131, and 765 in February and they were rejected because my Visa is not current.
My question is, can I submit 131 and 765 on their own with my notice of action (I 140 approval ) without the 485 as I wait for my PD to become current? Who has been through this here? Guide me on the process and the fees?
I also already have another EAD, do I check as a first time applicant or as one replacing?
our timeline
in the hope it helps all/anyone with your own journey I wanted to share ours - haven’t seen much in terms of what happens with the spouse if not approved at the same time so here’s how ours went:
Primary: L1A-EB1C ROW UK
spouse: L2-EB1C ROW France (Applied from UK)
- 23 Jan 2023: both filed concurrently (i140,i1485 + EAD & advanced parole applications) / i140 submitted with premium processing.
- 24 Feb 2023: i140 RFE (work responsibilities clarification) (both)
- 27 Feb 2023: biometrics taken (both)
- April 2023: EAD + AP approved (both)
- 2nd June 2023: submitted I140 rfe response
- 10th June 2023: i140 approved (both mine and spouse)
- 10th July 2023: primary I485 case transferred to NBC, Spouse remained at TSC
- 15th Feb 2024: primary I485 approved and new card ordered (no action on spouse)
- 2nd March 2024: primary green card delivered.
- 20th March 2024: Spouse I485 transferred from TSC to NBC
- 23rd March 2024: Spouse I485 approved.
- 5th April 2024: Green card delivered.
in total, around 14 months for both cases to be approved with cards in hand. our location in the US is New York but aside from fingerprints it doesn’t seem we ever moved to any specific local service center (at least we weren’t informed). the wait has felt like an absolute lifetime, especially being employment based and the turbulence in my industry but if I’m being honest, before I moved to the US I would have expected and accepted 14months wait for permanent residency so I feel it’s been okay overall. this app has been both a huge blessing being able to share/see peoples experiences but also very addictive and frustrating to see how much it varies on approval - I hope for everyone here your good news comes very fast and just remember, it might feel slow but it’s coming!
