i485 got denied and 130 got closed.
hello everyone,
I’m widow my husband is US citizen. our attorney didn’t know my husband passed away and attorney submitted 130 and 485 2 weeks after he passed away, that was in December 2022. and on 2023 March my attorney submitted another 360 as widow for me. I have received 2 RFE for i130 asking for proof of marriage. seems like the Uscis didn’t know my husband passed away or I submitted 360. I replied back the RFE of 130 indicating my situation and asked them if I could combine both of my i130 and 360 together in January 2024, and now I received the update of 485 denied and 130 was administrative closed.
Uscis saying that my i485 got denied for the following reasons:
“An applicant adjusting under INA 245(a) must establish that he or she is eligible to receive an immigrant visa and an immigrant visa is immediately available. See INA 245(a)(2) - (3). USCIS records establish that on 1/12/2024, you withdrew the visa petition filed on your behalf. You have provided no evidence to indicate you are immediately entitled to an immigrant visa on any other basis. Therefore, you are not qualified to adjust status.
You have not established that you are eligible for adjustment under INA 245. Therefore, USCIS must deny your Form 1-485.
any thoughts on that? I’m depressed now.

2) is it my ead card under c31 . i already have c9 untill 2024
3) will my dependents 15 years and 21 yeards old also included , will they receive . I have applied for them too but i only received one receipt with their names on the receipt in the bottom. i am worried for my children whether they are a part of my 360 on not . their bilogical father( my 1st ex husband) applied for h4 for my children and they are on h4.

VAWA Feb/ March/April 2023 Filers
Hey VAWA folks, anyone filed in March 2023 who has received Prima facie/biometrics? They transferred my case from vermont to Nebraska to speed up the processing. I am yet to see the speed though haha.
Still yet to receive Prima facie/Biometrics though I have seen some March filers get theirs. I wish this process could be faster like how I-130 processing is faster now.
