Uscis responds to my congressman. Case Dec 2021
U.S. Citizenship and Immigration Services (USCIS) records confirm your constituent’s Form I-360 was received on December 13, 2021, and remains pending with the Humanitarian, Adjustment, Removing Conditions and Travel Documents (HART) Service Center. Approximately 80% of this Form type is completed within 40 months. The petition is considered within normal processing time.
the petition is still under the review process and could be denied, your constituent has demonstrated a substantial likelihood of being a victim of abuse. USCIS has determined through the review process, that your constituent met the minimum requirements for approval of the I-360 petition. Thus, USCIS granted an extension of the Prima Facie Determination (PFD) with the notice mailed on July 2, 2024. The PFD is valid for a period of 180 days from the notice date.
This PFD notice is meant to be used by your constituent in receiving any public benefits.   Your constituent's Form I-485 is pending at USCIS Vermont Service Center (VSC).
Please note that VSC does not process Form I-485's that are based on an approved Form I-360. Thus, should the Form I-360 be approved, the Form I-485 will be relocated to a field office for further processing. If denied, the Form I-485 will remain at VSC and be processed accordingly.
The Form I-765 was filed in the C31 category, or as someone with an approved Form I-360. Therefore, it will be processed after the Form I-360.”   I will continue to monitor the status of your case. I will follow up on your case in 3 months.
