is there a risk to get the STEM OPT denied if I apply to I-140 NIW while under initial opt ?
#NIW #Opt #STEM

Hi everyone.
I would like to share my experience with the USCIS.
I have been waiting for EAD card for 15 months.

Hope it will be helpful #i-765 #NIW #expedite

NIW Approved, how long for semiconcurrent I-485
Hi, My NIW I-140 received in TSC on Feb 4, 2021 got approved on Nov 5, 2021. My I-485, I-693, I-765, & I-131 were received by NBC in the beginning of June 2021 (on different dates, although sent together); then only I-485 transferred from NBC to TSC, and biometrics received on Sept 16, 2021. My combo card got approved on Dec 16, 2021.
1. How long it might take for my I-485 to get approved?
2. Although, my case is in TSC now the receipt start with MSC, does it change how I check USCIS timelines? Should the timeline be for TSC or NBC?
Thank you!

EB2-NIW Case Approved - a year later
My case was non-concurrent (applied for I-140 and I-485 a month apart) and ROW (not India/China). Case was transferred to NBC from MSC at the end of January.
RFE was for medical exam received at the beginning of August and response submitted end of August (delivered Aug 20, updated to say received on Aug 28 🤷♂️). Almost a month later it says approved.
Could give more information as needed. I-140 was approved in late March but approval notice kept getting undelivered. So ignore what my timeline says on I-140 approval, which took 222 days and for which I applied in Aug 2020. An exact year later, I-485 updated to say my card is being produced. I assume I’ll get it in a week-ish.
Not sure if the probable government shutdown will delay things, hopefully not. #eb2-niw #eb2 #niw #i-140 #i-485

I-485 Pending on an Approved I-140 NIW
Evidence submitted: job applications in fields of proposed endeavor; employed at a different field at time of application; still looking for new jobs. 65 citations at time of application, close to 90 now. two first-author, two second-author, 6 total; some peer review work; employer letter stating how my job helps in developing skills; personal letter explaining my goals; published just recently again, petition tied to how I’m addressing three points for NIW; three independent recommendations out of 5; some media coverage and recognition; of course also evidence of how it’s tied to national interest.
Had already obtained PhD in chemistry at the time of application, and was employed on STEM OPT.
No RFE was issued for NIW.
Was on student F1-STEM-OPT status at time of application, although H1-B was already approved but was going to begin in October. Filed I-485 a month after filing I-140 so technically case is non-concurrent.
Approval notice never received since USCIS may have goofed up on address. Have raised service requests twice now.
Law firm received my approval notice! Two times. Each time I didn’t receive it. I am told it shouldn’t have any problems for the I-485 since I filed it separately.
I-485: Was transferred from NBC to Nebraska Service Center late January, but no update since that would request medical evidence. Been about 180 days.
I have had biometrics done already and have an approved AP/EAD card too.
So two questions:
1) Would this approval notice not being delivered have issues for me or impact my I-485 application, since they were filed separately from I-140?
2) When should I expect to hear from NSC? I am past date ranges of what Lawfully predicts my case should be adjudicated by.

I-140 NIW approved in 6 months
I retained Yang & Assoc. for my NIW case. My attorney was Maryam Rangwala. I had a PhD but a pretty low research profile with 2 papers, 2 conference proceedings and 7 citations. But Maryam worked hard with me to build my case well and I got it approved without any RFE and in a record time.
timeline:
I-140 received by USCIS on 9/17/2020
I-140 approved on 3/22/2021
