RFE after i—140 approval
Hi everyone. so wanted to know if anyone has similar experiences. kinda weird but well. I filed for i-140 Nov last year and got approved early this year. received my approval notice. Then several 30+ days later I receive RFE on the already approved i-140. Lawyer responded to the RFE basically saying we have the approval and it stands because we didnt get any notice of revocation or that the approval was in error. its been 4 months since that letter was sent to USCIS. No response yet. any ideas #i-140, #NIW

1. Al completar mi DS-260. En la opción de PETITIONER para mí es SELF por ser el aplicante, pero para mí familia sería igual? las demás opciones no coindicen. Les dejo SELF a ellos también?
2. Mi PD es 23/12/22 aún no estoy en fecha pero he podido ingresar toda la información, puedo completar el DS-260 y enviarlos así aún no esté en fecha?

Hello everyone. I have two questions (Thanks for your help):
1. When filling out my DS-260. In the PETITIONER option for me it is SELF because Im the applicant, but for my family it would be the same? the other options do not match! Should I fill SELF for them too?
My PD is 12/23/22 Im not yet dated but I have been able to enter all the information, can I fill out the DS-260 and send it in even though I am not dated yet?

I-140 (NIW) receipt notice delay?
Recently filed I-140 (NIW) petition package. The package was delivered at Dallas Lockbox on 5/23/2023.
I haven't received a receipt notice, the check has not been cashed.
Emailed Lockbox support about 2 weeks ago, no response. Several Emma chat that ended abruptly by the representative directing me to email lockbox support.
I am getting really frustrated... Anyone in the same boat? Should I refile? #receiptnotice #I140 #NIW

My immigration options are given below:
October 2022: My employer filed PERM, but not yet approved.
January 2023: NIW I-140 approved.
May 2023: EB1A I-140 approved.
I have the following queries:
1) I want to clarify if having an approved PERM means I have obtained the priority date. Is it necessary to file an I-140 after receiving PERM approval through the employer to secure the PERM priority date?
2) If my PERM is not approved, but I file I-485 when EB1A becomes current, what happens if my PERM gets approved after 1 or 2 months of I-485 filing? Can I update the PERM priority date on my submitted I-485 application with the approved PERM? Will this shorten my waiting time for the I-485?

Hello everyone,
I would like someone’s input on my I-485 case. I have an approved I-140 (non-concurrent) and my priority date is 10-3-2022. My I-765 was approved three weeks ago. No news on my I-131 yet.
Two weeks ago I received a RFE from Kendall FO (non-local) requesting my medical exams. The RFE arrived at my mailbox, but no updates on this app nor on my USCIS account (just shows fingerprints were taken). Is it common?
My I-485 was submitted on 1-20-2023, that time and two months later my priority date was current, but now isn’t current anymore.
Any thoughts?

My experience is: never trust 3-month waiting. As F-1 AOS, case got transferred to FL in Jan and then waiting.

Expedite Request Documentation I485
Is in state tuition and eligibility for federal students loans good enough reason to apply for an I485 expedite? If asked, what documents can one provide to establish severe financial loss?
Are these reasons sufficient?
1- Difference of tuition in-state and out of state
2- Difference of total loan amount with federal aid and with private lenders
In all the total difference in tuition over 2 years is 50,000 USD.

RFE on 140
Hi All,
I have received an rfe for my 140 petition. The RFE is about all 3 prongs. The officer is not convinced on all three prongs. I have a US PhD in Biology, three papers, 45 citations and currently working as a postdoc at a US national lab on cancer biology. I do not have any underlying status at this moment other then pending AoS.
How likely it is to get an approval after RFE response? Also, what other options I have if it gets denied?

I-140 approved, how long until I-485 decision?
Filed concurrently I-140 EB-2 NIW, I-131, I-765, I-485 September 2021. I-131 got rejected due to some error so we refiled later in Jan 2022.
My I-140 was approved today. I am waiting eagerly for I-131 or I-485 in order to travel. Does anyone have any guesstimates on how long this might take for Nebraska? #I-140 #niw #I-485 #lin #nebraska #nsc
