you can get an approval if your RFE is strong and addresses the three challenged prong. You have a strong case, I suggest you contact a specialist in EB2NIW to assist with your case

based on what others posted compared to mine, it is a cut and paste RFE. in my case they requested more info an all 3 prongs. Got mine approved 200 days after response. I’m not in the science field but in business, so I added a business plan, got more recommendation letters and reinforced some of the aspects I’ve already sent at first.

@A R If all the 3 prongs were challenged then your attorney or whoever that helped you did a terrible job. You need to consult a specialist before responding to the RFE.

I got a denial after RFE in November 2022. Do you best answering to RFE but finally it's up to the officer. My denial letter was just a bulshit. Stupid officer just ignored my RFE response. If petition gets denied you can appeal and preserve your i-485. While waiting your appeal you can apply for eb1 and go IVP.

I believe that it's better to reapply after denial. The chances are higher. But if your goal to preserve 485 you may consider appeal. It's okay to send two petitions at the same time under different categories. Eb2niw and eb1a. One petition preserves your 485 and second gives you an option for IVP. That's what my layers told me.

@A R my appeal is still pending. you can actually find appeal statistics online. my goal for now is to preserve 485, that's why I did appeal.

@Artur D how about the EAD? Did they cancel it after the 140 denial? I hope you have it intact as you appealed.

@A R about two weeks after denial I got RFE on my 485 clarifying if I have any other 140 pending. I sent them my 290 appeal notice and USCIS accepted that. My 485 is okay for now.

@Artur D ans @A R Please I also need advise. My I-140 has been submitted through a law firm for about 2 years now. I submitted July 14, 2021. It will be 2 years in July 2023. I received RFE in June 2022 and responded in August 2022. Now it's about another August. My officer is XM2150. I don't know if that individual has forgotten me somehow or just decided to keep my file. Right now, I donou what to do? Everywhere is blank. The law firm aren't helping at all. Like you said, the first petition is watery, I was disappointed when I saw it. I had to follow through with them during the response. Although I have a masters degree but I think my case is strong enough. Right now I donou what to do. Does it mean I will just continue to wait forever? When I see people being responded to in 10 days, 2 months, 6 month etc.

@Read 1 you can convert to premium to get your RFE response. Even if the decision is not favorable it's better to know it as soon as possible. You can simply reapply and don't waste you time. I actually upgraded my case to premium after 61 days USCIS got my RFE response and got my denial after 3 days after PP.
