PERM Priority Date
My immigration options are given below:
October 2022: My employer filed PERM, but not yet approved.
January 2023: NIW I-140 approved.
May 2023: EB1A I-140 approved.
I have the following queries:
1) I want to clarify if having an approved PERM means I have obtained the priority date. Is it necessary to file an I-140 after receiving PERM approval through the employer to secure the PERM priority date?
2) If my PERM is not approved, but I file I-485 when EB1A becomes current, what happens if my PERM gets approved after 1 or 2 months of I-485 filing? Can I update the PERM priority date on my submitted I-485 application with the approved PERM? Will this shorten my waiting time for the I-485?

Is there anyway to reinstate green card if abandoned at no fault of mine?
If someone have faced this before, the green card was taken away after not showing in the US for more than a few years, however the age was 4 years old which means it wasn't "voluntary abandonment of status". Does anybody know anyone who faced this and is there anything to do to somehow reinstate the Green card? Thank you.

Can I apply for OPT while pending I-765 based on I-485?
Hi, I applied for a work permit through a marriage-based green card on November 28th, 2022, and I just now realized that it might take 15 months to get approved (compared to the 4-6 months I initially thought).
I am graduating in May and am interviewing for jobs right now. I am terrified of staying off I-20 status, and not being able to work (+ not being able to drive). Can I apply for an OPT (4-week estimated wait time) while I have a pending I-765 based on marriage?
I read somewhere that it could give confusing/opposing intent as one is an immigrant while the other is a non-immigrant, but I also read that the worst case would be the denial of OPT but no effect on the green card process whatsoever. Some have even said they have done so successfully. Your thoughts???

Hi everyone,
I currently have a green card for 2 years now and I’ll be eligible for citizenship in about 3 years(a total of 5 years). I just got married and my spouse overstayed her holiday visa and now I have to file for her(she is currently in the US too). I do see that for the category F2A the priority date is “current” meaning I can file both the i130 and i485 but the issue is I am seeing everywhere that I’ll need a waiver(i601A) because she violated the terms of her visa and because am not a citizen. So right now what will happen if I file for the i485? Will it be automatically be rejected without the waiver or will she be given a work permit until she is called for the interview then get rejected because she doesn’t have the waiver? I am asking because if she can get a work permit for now that will be good while she waits then maybe by the time they call us for the interview I would have been a citizen by then and the waiver will not be necessary. Derivative i485 | Using biometric notice instead of receipt notice
Hello everyone. I have a pending i485. Now, to file i485 for my spouse, I need to send evidence of my pending case. I didn’t get the receipt notice but I have the biometric appointment notice. Can I use this as evidence of my pending case. It includes almost the same information as the receipt notice.
Has anyone used biometric notice instead of receipt notice as evidence for derivative application? Please share your experiences.

question about filing form i765 for OPT with pending marriage I485 and I765
I am under F1 status currently. I have already filed marriage-based I485 and I765 and they are pending. But I received a job offer and want to start working ASAP, so I apply for OPT. There is this question 12 on the I765 form: "have you previously filed form I765?" Should I answer 'yes' here and explain my marriage-based pending I765 in the attachment? Based on previous posts it seems applying for OPT is feasible under this case, but I am not sure how to correctly fill OPT I765 without affecting my pending I485 application.

If the sponsor is a student with no income currently, getting married and starting a job in July after graduation with income that would qualify, would just employment letter work or W2/tax return is necessary? I am spouse of lawful permanent resident. i have pending I 130 (vermount service centre) filed by my wife a year ago while i was outside usa in my home country. current status shows that they are actively reviewing my case as of february 2022. i am currently in USA in B2 visitor visa. because of some family condition i have to stay with my wife. so can i apply for adjustment of status now? how long does it take to receive EAD and travel permit after applying for status of adjustment?
