what does that even mean? PD Oct20,2022. applied i485 March9,23. emma says this -_-

absolutely same situation. EB2 -NOW, PD October 2022. CRP since August 2023. zero movement for almost 5 months being current…

I have same PD. But, I am not in CRP but still there is no updates on my application since March 2023. SR sent by my Attorney last April 29th but still no updates. My Attorney mentioned that will call USCIS on May 30th. I think, they don’t want to check any of the Oct 2022 applications. Even though my AP is not delivered and submitted SR for that too and still no response. Very frustrating situation 😔

@F A i got my AP. my spouse's AP was not approved until March. And I raised SR by congresswoman, then it was approved( dont know if that worked). I raised SR by congresswoman for I485 as well. but that did not work.USCIS sent generic answer to her office saying they are working.-_- today again I asked Emma and got this reply.
I assume your attorney is supportive! I had to figured all these myself -_-

@niw-crp UR I am still waiting for my AP its almost more than 52 days my AP approved but not delivered. For I-485 I submitted request to Congress Representative a week ago but still not hear back from them. And Yes my Attorney is very supportive and helped me alot. But, the response is delay from USCIS with which my Attorney can’t do anything.

I got the same response from Emma today. I need to wait until a visa becomes availble. I asked,
“but does it for people who file after me” she said every case is different. im CRP since July. PD is May 2022…

@niw-crp UR based on Emma, and what I understanding how the system works based on previous case’s study, there are 2 possibilities:
1.) Emma have absolutely no idea what they talking about and they are wrong
2.) as bulletin July will retrogress ( confirmed ), the cut off date has been move back before October 2022 but it’s not official post to the bulletin yet. so what Emma said is right. To answer “why” other applicant with later PD than oct 2022 get approved because when officer start adjudicating their case a number of visa been issued to them before the retrogress cut off date starting. So it seems that after retrogress cut off date is officially happening, the timing when they start looking at your document recently, them made the conclusion that your case will not issue a visa number. it’s all about timing as what I understanding from previous case study.
people with earlier PD let say April - June 2022 that might be not affect by their cut off retrogress date, may still able to get a visa number even their case is not yet review today and being review next month or so as long as they are still current.
Unfortunately nobody know how’s the system works behind the scene. And one thing for sure - they never honor first come first serves system. its very not fair they adjust late filer than earlier filer.

my PD always current since January and I submit 485 in January. it’s still pending day 116 I’m still waiting. let’s just hope for the best 🙌🏻

this doesn’t make sense to me. Emma mentioned that his visa number has been retrogressed. It means his case has been assigned a visa number. However, Department of States has only a certain number of visa numbers per fiscal year. Does it mean USCIS won’t use all the visa quota? so, it doesn’t make sense.

@JJ M I hope I’m wrong about what Emma just said, I wrote that way because based on this original post, Emma said even date are current but visa number has been retrogress. so I’m trying to figure what Emma mean, but let’s hope they have no idea what they talking about, and let’s pray for us 🙌🏻🙌🏻

Submitted in Oct 2023 (PD Dec 2022); Placed in CRP mode since Jan 2024; Got EAD in Feb 2024; and finally got I-485 approval (family of four)in May 2024. Patience with God is Faith!
