EB Case Remains Pending - Time to approval
hello folks- this question is for those who are in EB categories and had been to CRP (Case Remains Pending) status because of Visa unavailability— roughly what timeline you see for approval after your dates becomes current. so for example- if you become current in Oct, did you get approvals within the month or after a few weeks. Request to please fill the poll too.

thanks all for responding and voting! @Lena EB1-A @M P I wish you luck! it seems very few get it within the month. luckily in the beginning of fiscal year, dates remain current longer so hopefully you will get it soon. CRP might be a bad situation in later months when it is your turn and you can retrogressed quickly . again wish you luck

I thought EB1 visa category is current, particularly for ROW, how come visas are unavailable or cases are going into CRP? someone explain, please

Thanks for the poll @d s. Very helpful. Btw, what does CRP mean. 1. Does it mean that USCIS doesn’t need anything else for the applicant, just wait for VISA to be available? 2. Or, does it mean they will start looking at it once VISA is available, and will send RFE etc if needed then.

@FlyHigh ❤️ there are ROW people from sep that were retrogressed and there are Indian and Chinese national that are not current now.

@d s Oh wow! Really EB1 had a retrogression too? I thought they remained current for all ROW, excluding of course China, India, Mexico, etc

@Jay M It is written in USCIS policy manual that officers needs to adjudicate the petition until the point it is completely approvable( be it needs an interview, medical or whatsoever). In the event that visa number is not available, but remaining things are done , it is marked as CRP. however, sometimes a lot of time passes and hence they may need to verify employment offer validity, background check might have expired so needs revalidation, etc etc). depending on status of individual case, it can be a few weeks to few months as evident from poll too

Q. What does a “Case Remains Pending” message mean in the USCIS Case Status Online tool and is USCIS proceeding with the adjudication of applications displaying this message in FY 2023? A. A “Case Remains Pending” message in the USCIS Case Status Online tool indicates that an officer reviewed the application and determined that it could not be approved on that date because DOS could not allocate a visa number. Once a visa number can be allocated, USCIS will resume the processing of the application but not every action that USCIS takes on an application results in a change in the message displayed in the online case status. If the applicant has submitted a transfer of underlying basis request, USCIS will continue processing that request and moving the application forward in the adjudication process. (Updated 03/22/2023)

Thanks @d s It doesn’t explicitly state the need for the officers to adjudicate the petition until the point it’s completely approvable though. Is that based on what you saw happens in practice? I think I saw a post where the PD is not current but the candidate was asked to appear for an interview.
