Case Remains Pending
Hi,
I -485 status changed to “ case remains pending” and reads We are temporarily pausing work on your application because an immigrant visa number is not immediately available to you. Once an immigrant visa number becomes immediately available to you, we will resume processing of your application. This is for my wife and myself both cases.
Has this happened to anyone before? I am EB2 category with a PD of Sep 2022. I-765 is approved.

I think it depends on your Country of Birth even if it’s within Rest of the World category. There is still a cap per country.
If they’ve issued the maximum number of available visas to applicants from your Country of Birth within the current fiscal year, then your case may go to CRP.

@NoHope CRP are you sure they are wrong? It clearly says no country can get more than 7% of GCs per year so your country may hit the limit even within a category that still has green cards.

I believe by country, they mean one of the five region (China, India, Mexico, Philippines and ROW) - to be verified

You can sue USCIS for delay on your own, if you cannot afford an attorney, my friend did it for his delayed case, and got papers within 45 days. Do youtube search to learn more about it and to get some help "writ of mandamus pro se"
