your opinion about my case. is there a chance of success?
hi guys, I’am a production engineer and I came from Poland a few years ago. I did f1 status (student visa), found employer and my lawyers applied me to eb3 unskilled category (administrative assistant) despite mine higher education level. a week ago we sent a i140 process by regular process, my pd is October 2023. guys my question to you is. My case has a chance to success based on what I Wrote? if you need more information in this topic,let me know. for every each answer thank you very much.

why not?? there are many cases. In eb3 unskills processing , important thing is not a degree or your job before. it's far more important whether this job is legitimate and valid. but why didn't apply eb3 pro or skilled workers. eb3 unskilled have a huge backlog now. at least 4-5 years in other countries.

This company is small, it only hires 1 person on payroll, the rest of the people are employed on subcontract. It is a company that makes kitchen cabinets and installs them in homes. A small company with some turnover. I think that this company does not qualify to employ people with such education.

what ar you mean when you said “job is legitimated and valid” in my case? do you think I can trouble with my ‘administrative assistant’?

First of all you are a product engineer which qualifies for an eb3 skilled. Second, it does not make sense applying for an unskilled that is so backlog it wound take you 5-7years of waiting when you can apply for a skilled with a higher visa allocation. Third, i doubt an administrative assistant can pass through i-140 especially any US citizen can take that job. Lastly, the company petitioning you is highly doubtful you got only 1 in the payroll, if I were the officer reviewing that it is already a red flag because the company should have a healthy financial statement in order to petition somebody. Why would a company go through so much pain in hiring an administrative assistant when i can get somebody by tomorrow? that in itself is already a red flag.

Why don’t you ask all these question to your lawyer? here all of us can only kick a “good answers” and when it’s comes to immigration it’s better not to guess anything…a wrong advice can mess up the things.

hello, thanks for all the answers. this motivated me to go to another lawyer for advice. first of all, he was surprised that I was qualified for eb3 unskilled, he suggested that after obtaining approval i140, I should go through perm again and jump to the category of at least skilled. I thought about it a bit, but with the current processing time the entire department of work(DOL) takes at least 2 years. even if I went this route, it would come to the same thing. (I think that my pd in October 2023 will be achieved in these 2-2.5 years).
