Writ of Mandamus??? Yes/No
Hi guys! I just wanna ask for others opinion on this. I know the wait time is crazy but I’m getting so tired like others but unlike others I am ready to take a risk. my priority date for my i360 is 03/2022 Now seeing how USCIS keep extending the date. It’s been 28months now for me. I want to file a Mandamus to force them take action on my case. I believe the worst that can happen is for them to reject my mandamus & ask me to wait for when it’s my current date or if I get lucky they make a decision in my case. I am extremely tired of waiting. Before going on with this, I just want to hear other opinion or if you know anyone who have taken a similar decision before. please be kind with your words! Thanks everyone!

if. i were you wait they would not have to approve cuz it is 40 months now they might send you noid idk if nothing emergency dont do it

you’re in the normal process time wait for another 12months I filled on November 2nd 2020

first , you have to send request why is your case takes so longer , then try expedite and last step file mandamus . did you ever contact your congressperson? mandamus will no issue for you because of you are in normal t processing time

@Steve se I don’t wanna wait another 12months. I figure I can try. I’m well aware of the risk - which is deny my mandamus but I don’t believe they will deny my case on what ground exactly. my case is pretty solid

be PATIENT, we are waiting here since 2020 and 2021 for decision, you’re 2022 filer. be also respectful to us! Your answer to @Steve se is kind of rude, and you ask us not to be rude to you! if you are so sure, 100%, why you asking us lol

I filled on Feb 3rd 2022 and im still waiting hopefully to see a good response.for now I’ve not seen any approval for 2022 presently.ill advice you wait a lil bit even though you still wanna go ahead with the mandamus

Filing a mandamus against USCIS while your case is still within the normal processing time is premature. It involves significant costs and time, and it's challenging to prove undue delay and significant harm. Taking legal action might harm your relationship with the agency and affect future interactions. Prioritize alternatives like the expedite requests you’ve already submitted. I think in your case it’s to early.

Thanks everyone for all the advise, as expected you all said No but I have decided to move ahead. I will come back to update you guys later in the coming weeks!

@Nicki M you just applied and are still in normal processing tine. By filling WOM they can deny you without sending RFE or NOID, so you are not doing yourself a favor but that's your case and your future. Good luck!

@Mrkvica M. AGREED! Too soon, youre still in the normal processing time. it will likely be a waste of money WOM is atleast 5-10,000. Be patient, im a 2020 filers still patient waiting. youre 2022 filer. @Nicki M

@Nicki M im on your side man. do it. im oct 22 and waiting 2 years to be done. then im filing mandamus. i got nothing to loose. my case is extremely strong
