if the spouse doesn’t appear then yes they will deny your i-485, you can plan to file vawa and when you attend the interview without your spouse (make sure you go for your interview so they don’t deny it and put you in removal proceedings) just have the IO hold the current i-485 in abeyance so your EAD is still valid and can continue working. Then file for Vawa (emotional or physical abuse) based on your situation. This way you can keep renewing the work permit as you continue waiting for your vawa to be approved. Best of luck! make sure to keep any form of threatening text messages or voicemail and you can use those as proof, and if you have an approved i-130 include that in your vawa package. Remember should your spouse file for divorce you have 2 years to file for vawa. Make sure to go with a lawyer even if you hadn’t planned on it. Best of luck!
