vawa i360 will replace i130. You will still maintain same priority date as i130.

vawa is a long journey, if you can wait to get i130 and i485 better for you. do not risk your life if you are in a violent abusive marriage. Only the living can get approval

JJj is absolutely correct, provided you are not able n any kind of danger with your abusive spouse, I will suggest you just wait since you are about to get approval but if you are in danger, I suggest you run for your life and file i360 but I must tell you, that’s a long wait and pain and you must ensure you have proof of your abuse, as in a lot of work for you to put in, it’s not a easy process to be candid

@ lala lala the reason why am thinking of filing VAWA is that incase am denied cus I heard if a case is pending long it’s either approve or notice to deny. but if it’s denied I have evidence to file for VaWa.

I will advise you to wait but keep your vawa evidence. If you are sure your spouse won’t go to interview with you, then file for vawa.

@Nina MR 💯 agree with you, an immigrant in a serious abusive marriage situation would have filed Vawa and seek for safety. But the owner of this post is waiting for his i-130/i-485 to be denied first before filing Vawa, makes me wonder if he his really in an abusive situation or just want to make things up to go in his favor. Some people are abused and battered but chose to endure. If they get denied or the marriage crashed, they can choose to file for vawa. At the end USCIS is the one to make the final decision and not any of us.

@ bekind I was only asking if it’s been denied cus am the one that went for interview and knew how it went. also been abused doesn’t mean physical but it may be emotional, extortion, threat .. so I know my reasons asking for the line if denied. i know VAWa is long so I will prefer everything work fast so i can get my green card this year because I have been with her for 4 years already and case pending for 3n half years now. I just don’t want my years with her wasted..

each to their own .no need to be judgemental. why do people assume they deserve more than others? smh. it's crazy to think others haven't gone through hardships and judging from a statement here. let's not look at others with negativity. we are all immigrants who are equal noone deserves more than others . imagine a fellow immigrant being like that and treat fellow immigrant like crap what could have happened if they were Americans? lol
