Will I 485j rejection cause I 485 denial? Will I have 60 days to get new job in same category? #eb1c India
I 140 approved, EAD issued & I 485 is pending over 9 months. My existing org is restructuring and I have offer for another job for which I want to file I 485j. Will I 485j rejection cause I 485 denial? Will I have 60 days to get new job in same category?

@R A You can surely submit the new 485j but the job duties should be similar. Ideally they will send an RFE before any action.

If they send RFE and don't approve of the profile, will they give me time to change job(assuming I am in new job by the time they decide on it since it takes forever ) or will they reject I 485 along with it and I will have to leave US?
no, there hasn't been an update since the center change to National Benefit Center in Dec 2023.

@R A from what I have read, unless they ask for a new I-485J, you can just take the I-485J with you in the event of an interview and so long as your role is similar or more senior than the original role, you should be fine.
but 9 months is a long time for application to be pending (or even since November - when your I-140 got approved). Is there a reason for the delay?

@R A if you have a look at casestatusext, you will see that cases are getting adjudicated in less time than that. they are currently adjudicating cases from Feb/March 2024 receipt blocks.

@R A I don’t think you can expedite a pending 485. If you call them, they will say 80% are adjudicated in 30 months so it is within the timeframe.

@B J what is casestatusext? Where do you see the current receipt block being adjudicated? I am from India and not ROW, would that make a difference?

I’m confused why someone with a PD of 2017 for EB1-India is still not approved despite being current for so long. how are they moving the final action dates to Feb 2022 in July bulletin if cases like this are pending.

@kay r the PD of 2017 was in Eb2. Eb1c was filed in 2023 July.

@B J checked casestatusext for I485 graph. it has highest number of cases being adjudicated under IOC and MSC blocks. Mine is under LIN and is there a way to know what is the total number of applicantions under that code to know what % has been approved?

@R A if I am not mistaken, all applications of Eb1C are in MSC. I thought I read that somewhere. They may transfer to an FO but it’s generally NBC (MSC).

@R A I also applied in 2023 July but my PD is 2021 from EB2. it’s just confusing to understand if they go by priority date or receipt date for these applications.
