Wife’s separate asylum case still showing as pending after she received derivative asylum — how do we withdraw it?
Hi everyone, I’m hoping someone has been in a similar situation. I was the principal asylum applicant, and my wife was included in my case as my derivative. My asylum was eventually approved, and my wife was also granted asylum as my derivative. The problem is that my wife had also filed her own separate I-589 asylum application, and that case is still showing as pending. After our asylum approval, my wife received an interview notice for her separate asylum case. Our lawyer contacted USCIS and explained that she had already received derivative asylum through my approved case. The lawyer asked them to remove/close her separate asylum case. However, the case is still showing as pending, and she continues to receive Annual Asylum Fee notices for that case. Then, three days ago, she received another notification regarding the pending asylum case. What should we do to properly withdraw or close her separate I-589? Should we send USCIS a signed withdrawal letter? If so, where should it be sent? Should we include copies of her derivative asylum approval and my asylum approval notice? Has anyone successfully withdrawn a separate pending I-589 after becoming a derivative asylee? We just want to make sure the separate case is properly closed and that we don’t do anything that could cause a problem with her existing derivative asylum status. Thank you!
