What to do after denial?
This question is for those who got denied. What are you guys doing? 1. are you planning on filing for motion? 2. If it is not approved in 6 months, what is the plan as that will start accumulating the unlawful presence? Any other suggestion?

Depends on the Denial. If your denial is discretionary then it’s uphill battle, but if your denial is not discretionary you can sue uscis in federal court. Unfortunately due to political mess I would suggest move to Liberal State where federal judges are very liberal which can help your case.

@Amin Goretz why you think discretionary is uphill battle?

@sharmeen moona because Supreme Court ruled in Favor of USCIS of Patel vs Garland. After 2023 USCIS discretionary denial is hard to fight but you can still fight in federal court if they are using any baseless allegations against you!

@sharmeen moona What was the reason for the refusal? They should have stated the basis for the refusal — what violation or suspicion it was based on.

@sharmeen moona pls reason so we can prepare on how to avoid same situation
Bill : )Aug 29, 2026

@Bill : ) yeah bro these people only asking for help when needed but stay quiet when others needs help. Like we all trying to make it right, the denial reason could literally help thousands of people if they’re in same situation and better prepare for it but well what can I do
sharmeen moonaAug 29, 2026
to all people saying that we don't want to help and so on. you won't know how it feels until it comes to you. That's a lot to type and at this moment we are busy trying to figure out what to do. out whole world turned upside down. we may have to leave the country or I don't know what to do. we will reply when we have time. no one is oblidged to reply. probably keep the negativity to yourself. we haven't received the letter yet but judge all you want. shame on you for those comments.

@sharmeen moona I understand you're facing a stressful situation right now, and no one is asking you to put your personal matters aside while dealing with this. The point was just about how helpful information can be for the community, but your priority should definitely be your own situation first. Hope everything gets sorted out for you and wishing you the best of luck with your case.

@sharmeen moona BDV has lawyers who deal with cases like this. I think you should contact them. At this point, a lawyer who specializes in these kinds of refusals is probably the only person who can help you. Also, if you have children who are U.S. citizens, that could help, and you might be able to get a waiver. But to know what you should do next, we need to know the reason for the refusal, since you said you haven’t received it yet.

In the context of U.S. immigration (USCIS) and applying for a Green Card through asylum (Form I-485 under INA § 209(b)), "discretionary" means that granting the Green Card is not automatic. The final decision rests entirely on the discretion (free judgment) of the evaluating USCIS officer. Even if all statutory requirements are met, the officer must decide whether to exercise favorable discretion by weighing positive factors against negative factors. USCIS Discretionary Assessment * Positive Factors: Family ties in the U.S., a stable employment history, timely tax payments, active community involvement, and a clean criminal record. * Negative Factors: Arrests or criminal history, immigration fraud or misrepresentation, and traveling back to the country from which asylum was claimed. If the negative factors outweigh the positive ones, the USCIS officer can use their discretionary authority to deny the Green Card application—even if the applicant technically qualifies on paper.

little sad, but don't give up, you can still get your green card.
