what exactly overstay?
My friend originally came to the U.S. on a J‑1 visa for about three months, and before that visa expired she switched to F‑1 status and continued studying, eventually completing a master’s degree. While she was studying, she got married and applied for a marriage‑based green card, but the case was denied because her husband didn’t attend the interview, and she received a 33‑day notice to leave the country. Before those 33 days expired, she filed a new I‑485 with her husband after he changed his mind, but he again refused to attend the new 485 interview. She experienced serious abuse, financial control, threats, and manipulation, so she applied for VAWA. She is from Europe, and she previously traveled twice using Advance Parole.
Question is she overstayed her visa or not ? she can travel wotho getting this 3 years ban?
thank you guys

she did not overstay cause she switch to different category,
which is she had a removal order?
and yes she can travel as long she has not triggered the ban
and if she did while she adjust her status which is 485 she add the waiver

Overstay or not, her case sounds complicated and unfortunately now like never cases like that will draw extra scrutiny regardless. If her case is solid, with a clear timeline, strong evidence, and no conflicting information, no background check that definitely puts her in a better position to travel.
All I can say good thing she is a female, and chance if officers being a bit nicer to her and if she isn’t from third world country per say, no Muslim countries, no other targeted nationalities hope she’ll be okay. it’s just inhumane nowadays.
But times are different now, and she should be prepared to be stopped, inspected, and questioned at the border. Nothing is ever guaranteed. Hopefully, everything goes smoothly for her, but until we’re naturalized, I feel like there’s always some level of uncertainty. All the best to her.

Similar situation for me, I also received that 33 days to leave notice because my husband didn’t attend interview. I filles Vawa after those 33 days. I am also from Europe and travelled multiple times since then without issues
