Waiting 44 Business Days with NO Updates – EB2 NIW Premium Processing
Is anyone else waiting 44–45 business days for NIW Premium Processing with no update? Today is my 44th business day and still NO UPDATE. The status shows: “Case Is Still Being Processed By USCIS.” PD: December 18, 2025 Texas Service Center Is USCIS now using the full 45 business days to respond? I would really appreciate hearing your recent experiences. Thank you!

i have counted president day as Holiday but I have checked that the premium processing clock starts from December 18, 2025 = Day 1 , in that case 45th business day is tomorrow February 24

yeah on 45 business day 6:15 pm I got a RFE , they took full duration to click for an RFE, I don’t how react on this !!

For EB-2 NIW premium, U.S. Citizenship and Immigration Services guarantees action within 45 business days, not approval. Action can be approval, RFE, denial, or refund if they miss the deadline. Recently, many NIW premium cases are going very close to the full 45 business days, especially at Texas Service Center. At day 44, you’re still within the guaranteed window. If they go past day 45 with no action at all, they are required to refund the premium fee while continuing regular processing.
