VAWA while I-485 was pending
Hi guys! I just wanna know your experience please. I have I-130 and I-485 with my ex since last year. Both case are never withdrawn and I asked to hold my I-485. This year, I filed for VAWA. So do you think they use PD of I-130 for my VAWA? I have heard that we can ask to transfer but I’m not sure my lawyer did or not or USCIS will automatically do that. Thanks for sharing!

im in the same situation. my 485 was hold when i switched to vawa. my 360 was approved october 14,2022. no movement on my 485 still. its been a month! i have not received any notification thst my 485 was transfered or whatever. im confused who will be approving my 485 is it Local office or vermont office. my 485 was filed in los angeles

@marvin. I have heard that you FO will adjust your I-485 by scheduling or asking for medical. When did you file I-360 and initial I-130?

@rachel i filed my 485 and 130 august 2019. medical was also sent together. im also thinking if i will receive a RFE for medical. not sure how many years is medical valid.

@gods good, submitted my 485 and 130 august 2019. switched to vawa august 2021 and request to hold my 485. 360 is approved october 14,2022. month now since approval no movement yet

@marvin The medical is just valid for 2 years. I guess you have to do it again!

@God's i really dont know how it works when its hold. its been a month since my 360 approval. i tried checking with emma my 485 and she told me its restricted to access. i guess all vermont cases are sensitive

@ gods i have working permit under c31-approved vawa. no combo card. no plans of going out of the country anytime soon

well I think they use you i130 for wava if you had i130 and i485. they’re gonna just add i360 to your case. but as im understanding, it might effect to the period of approval the case cuz you’re changing the case category, its my just view and im not lawyer!
id say wait and discuss all the needs for i360 with your lawyer

@Only God Can Do It ✅ ✅✅ I’m not sure, these types of paper were done by my attorney but I think you can find some samples online
