When my mom called they always put us on hold or not answer us, also we didn’t have a lawyer.

@Said Khan @Edd gallardo You need to file one under C09 if you have an I 485 pending because C31 under VAWA does not get approved untill your pending VAWA is. Depending on your state you can research pro Bono lawyers that could potentially help you for free.

@Said Khan Unfortunately, you gotta wait until your mom's vawa case is approved. After, it is approved, you'll apply for your i-765 with a copy of your mom's vawa approval notice and along with other supporting documents. You must need to provide a document (birth certificate, etc) that you're her son. As per uscis, "Approved self-petitioners and their derivative beneficiaries are statutorily eligible for employment authorization. USCIS may issue an EAD to principal self-petitioners upon approval if they requested an EAD on the Form I-360, VAWA self-petition. Derivative beneficiaries may apply for an EAD by submitting Form I-765, Application for Employment Authorization, and supporting documentation of the principal’s approved self-petition and of the qualifying derivative relationship. Persons eligible for employment authorization based on an approved self-petition receive an EAD with a (c)(31) employment authorization code."
