@rody cham - pictures of bruises, affidavit from someone who witnessed one of the domestic violence occurences with proof of call to 911, screenshots of messages from my ex abusing me verbally & emotionally, psychiatric evaluation which I've been assessed to have had anxiety disorder, PTSD, & major depression. My case took 26 months.

Did you had EAD from marriage before vawa application? if you had, was the EAD still valid after you applied for the vawa?

@stella rob - yes I had EAD from marriage and it will still be valid as long as it hasn't expired even if you get divorced or applied vawa.

did you do uncontested divorce ?

@tika lali - i485 is still pending because I filed vawa. i-130 was withdrawn but that wasn't a problem because my adjustment of status is now based on approved vawa

@lala lala - requirements and eligibility for uncontested divorce depends on the place of residence. I hired a lawyer for my divorce so & he did the work for me so I can't really explain much.

Oh I see! Did it cost you so much and how long did it take to get it done. I apologize for too many questions, it’s just frustrating!

@lala lala - no worrries at all! I paid $3k to my lawyer & I waited 6 months for it to be finalized.

@help lord - I got my first EAD from my marriage-based i-485, this new EAD that I will be getting is from the approved VAWA case. Go to your interview, let the immigration officer know that you filed I-360 and ask for your I-485 to be held in abeyance. The I-130 will not matter anymore as long as your I-485 will stay pending because of VAWA. I'd suggest that you find a shelter if you're experiencing domestic violence.

@Lucia S congratulations !! I am in the exact same position as you. I filed 02/03/2020 and received my c31 EAD and approval notice in April. I held my I485 (from my marriage) in abeyance and is now based on the VAWA and my divorce is also almost finalized. I’m truly hoping our I485 process won’t take another 2years and 2 months. I reached out to my local Congress woman last week and they made an official inquiry on my behalf for the I485 to resumed/decision to be made. Please keep me posted if you have any updates on your end for the I485. crossing fingers for us! 🤞🏾

@k m - Thank you! I also sent a request to my congressperson's office to place an inquiry with USCIS for me regarding request to transfer my i485 back to my local office for adjudication. I haven't heard back from them yet so I hope I will receive some good news soon. Let me know how it goes for you too!

@marc j & k m - no updates with my i485 yet :( I asked my congressperson's office to send an inquiry to USCIS for my case about where my application is now but we haven't received any response either

@Lucia that's a wise move, congressional office seems to be the only way to move things forward. It seems like I-485 is usually approved within two months, I am sending you my prayers and positive thoughts! I am in the same boat with you, I-360 recently got approved, I recently received my C31.
