vawa dependant
for person who petition for their child through vawa, what does it mean when they transfer the child case to another jurisdiction. They only transfer the I131 and i765.

@lord 🥰 my initial application I include her name, however she's here with me so i went ahead and file AOS for her along with combo card. my vawa isn't approved as yet though

@lord 🥰 same here. I included my son as a derivative beneficiary so whatever I'm approved for will automatically transfer to him. Applied for his EAD in November and it was approved as well to be received today. If your vawa is already approved, you could just file the AOS for your child as a derivative applicant. Depending on the age you can do work auth as well

@shari Mc I'm not sure. I'm still waiting on that end. I know they're adjudicating the I-485 because they updated the fingerprint info the same day they approved the VAWA. They'd already updated it in 2021but I guess they had to activate the file again...idk, go figure. Maybe they adjudcate kids in a separate facility since they're usually easier

@Kerry S thanks yes my son is 5 years and I did not include him in my vawa but my vawa is approved already and my combo card got approved last month now waiting for my I-485 so now how to help him ??

@lord Apply for his I-485 as a derivative applicant. Granted, since he is 5, once you become a citizen, you can just add him to that since he'd be younger than 16...verify this. I read this on the site a few years ago. If you're a citizen your child automatically becomes one by descent so you'd only need to fill out an application for that. Short answer, apply for AOS now because I believe he'd need to have a GC, now that I think about it

@lord 🥰 yeah, you're fine. I just looked it up. Once you're approved for VAWA you can just apply for his I-485 as a derivative applicant

@lord 🥰 I thought your child was in the US. In this case, you'll have to wait until you either have the green card or are a citizen to file the I-130 for your child.

@The Fantastic 5 if I remember correctly, I think that's what I did as well. I included my son as a derivative and applied for the I-485 for the both of us so that once the VAWA is approved they'd process both AOS applications. Is that what you did? If you didn't apply for the AOS and your child is here you can still do it

@The Fantastic 5 you'll need an application for your child to adjust their status as well. It's good they already know you have a child so they will be expecting an application. If you hadn't included any information about your child and then applied, then that would have raised questions after

@shari Mc maybe children are just processed elsewhere. The government has a million departments within departments so who knows. At least you know they're doing something with it
