I got denied back in November... I filed May 2022 I got a lawyer and appealed. So far only case was received and receipt notice sent

what kind of evidence did you submit? maybe you could appeal the decision

@ayel yael he said appeal but they want more money, we can add more evidence and clear misrepresentation their officer pointing out with proof but lawyer said vawa now very strict specially for older cases, his office received noids for cases 2020-21 and all the old cases now handled by fraud department. even if I’ll appeal I can still be denied. I’m thinking if I should just marry my boyfriend but my lawyer said it will be bad, because they will deny based on vawa denial.

I was afraid to go over this path again now I’m upset I didn’t fully explore everything. my lawyers office said only response they waiting for vawa cases from 2023, 2020 was only my case and 2021-2022 either noid or very specific new updated RFE they never dealt before. but maybe he just trying to scare me I don’t know who to trust anymore

you can file again and appeal at the same time. I did it before with my 485. no worries. just be focus and work on your case thoroughly. sometimes it depends on an officer who reviews your case. I recommend you to refile and appeal it.

please answer few questions that will help is making an assessment. 1. How did you enter the country and when? 2. How long was the marriage when you filed Vawa? 3. do you have any criminal history? 4. Did they issue a an NTA? 5. total of how many RFE you got throughout the lifecycle of application? 6. Did you had applied any immigration application before filing Vawa?

Ok you left out a crucial answer, when did you come to the country because there might be a way based on the time a 1 more benefit that you can file. Anyways my assumption is you entered on B1 and got married. Did you get married within 90 days of arrival? or did you arrive and over stayed and then you got married, if you can tell me the year of your entry I can recommend the benefit.

@Albina H it is not for denial, it is for the next steps. if you have been in country more than 10 years then you can file for COR - cancellation of removal and for Vawa cancellation of removal that period is 3 years. so yes it is related to your situation.

@Albina H did you put officer shelby in your claim or how possible did they detect fraud in your background check??? with no criminal history.

@Quiet Rebby no it’s officer Shelby from fraud department who have determined that my background check showed them inconsistent with my personal statement and affidavits. fraud department is handling vawa cases now, doesn’t matter you have or you don’t have a criminal history, it’s on them now to handle old and weak cases as I was told by my lawyer and that’s what it says in my letter

@Good vibes For ever I know what inconsistency are they don’t just say denied, they now issue every reason and denials come with pointing out what was the problem and issue and my lawyer just told me it’s a new but not unusual based on funding of USCIS by new administration and that fraud now took old vawa cases from December 2025. if your case is not older than 2023, I don’t think it wil be a problem

Did you have AP and EAD? did you ever travel overseas?

Every category they had an issue with my evidence. No new evidence just got a lawyer. I did everything at first myself.

@Albina H it's about 4 pages long and list the category along with their decision with explanation...Example the life insurance was taken out when we resided at the location before our marriage back in 2021. Dec 2021 we moved and the application was May 2022 and has the new address (they said it was a discrepancy with address) No I never updated address. little simple shit they are nip picking about. @Katrona Farrington thank you. my lawyer said it’s ridiculous for them to say I’m lacking evidence when in fact I have tons of them, we don’t know how to handle, contradictions can be proved with evidences and I will do that. one more question please, does your contradictions they mentioned in your denial comes from your updated last RFE your first submission?! wish you all the best!

@Albina H my second RFE was all that was sent initially with an updated self declaration. It is so pety (for good faith the wedding picture they said "You are standing next to what appears to be your husband") like really? @katrona Farrington I got denied too in last month. and denial notice looks just like yours.. it’s crazy and too petty. nothing like fraud was mentioned but contradictions and good faith marriage they based on to deny me. I’m working it out with my lawyer to appeal. they should not have any reason to deny it this time

I did file all evidence myself and I am not in the country but I am sorry you are going through this. did you write the statement in your native language and the translated it ? or did you write it in English ? maybe there have been some differences which happens sometimes.
