you can do it if you have no overstay/ have not been out of status.and ofcourse if you have i-485 pending now. it takes a long time for the work sponsorship but vawa won’t be denied. you can have them both pending concurrently.

@tired from waitingg, huge respect waiting this long. Circling back on your question, yes your employer can sponsor you, without any issue under EB category! I believe it wont effect your VAWA self-petition. Again, not a legal advice, please check with attorney. Moreover, why haven't your VAWA petition adjudicated this long? and have you tried Congressional enquiry > ombudsman? Nevertheless, you have a very good reason to even try Writ of mandamus? Not sure, maybe your are fine with the wait? Good luck with your EB.

No don’t do it. I had same issue and my attorney warned against it. let me explain, if your employer sponsors you, it’s going to be on H1B except if they’re agreeing to filing green card for you if not, H1B is only 3 years and that will cancel your VAWA EAD which I believe is 5years. You can’t have both concurrently as one overrides the other. Also you want to be careful because if you loose your job and does not secure another one in 60days then that H1B (employer sponsored EAD) becomes useless and you may have to leave the country. I also need to ask, how long more is your VAWA EAD valid? please weight your options well before proceeding. Goodluck…

hello, you cannot have any of this employment based green cards unless you have a non-immigrant status in the USA.

@Ann B it's called dual intent. Yes, you can hold an H-1B visa and have a pending VAWA application at the same time, and holding an H-1B will not cancel your VAWA case.

@M G S I didnt say it was going to cancel her VAWA application, I said it will cancel her VAWA EAD if she activates the H1B. Remember once she activates it, USCIS will cancel the one she currently has and if VAWA is canceled and maybe she looses her job and not able to secure another within 60days, then it becomes complicated. Just be sure of the decision you want to make.

@Ann B sure. by looking at how long he's or she's waited am sure by the time the other EAD is out the verdict from Vawa will be out. If I was the one I would take a gamble in case anything go wrong with Vawa. Also when Adjusting status from Marriage based visa, the EAD does not cancel just because you have applied for Vawa. Am not sure about that part. However, each to their own

@tired from waitingg @Ann B you are wrong here. if you had ead and you get H1B, that doesn't cancel out the already existing ead. in fact now you have two work authorization. I can tell for a fact because I had both EAD and H1B at the same time. I left the country and entered at the same time. but the issue was the officer asked me if I want to enter the country based on ead or H1B and I said H1B and no issue after that. unfortunately I got laid off during covid which made the h1b void after 60 days.
