Vawa cancellation of Removal(42b)
please family I want to share my story to see if anyone has been through this or have someone related to similar experiences. I married my US citizen spouse in 2017.we live together with her daughter and do everything together.in 2019 we were called for an interview and we both attended even while she was heavily pregnant, we did our baby shower and she eventually gave birth to my son whom I name after my father.in 2020 after she gave birth we were called for second interview.after much questions and answers the Officer ask us to go that we hear from her.two weeks later I got a mail from USCIS requesting for the DNA of my child,with that I was very happy and took my son and my wife to do the DNA.three weeks later I got a letter of denial that the child is not my child,so I was placed on Removal proceedings.I couldn’t believe it so I waited for my wife to come back from work and I showed her the denial letter.she was so furious that the child is mine.so after much intervention from family members another DNA was carried out and it shows that the child was not mine.at that time it dawn on my spouse and she started confessing her sexual exploit when I traveled to work in other states.church members and pastor intervene and because of the love I have for my family I continue the marriage and so we decided to refile another petition proving the burden of our marriage.in feb 2022 4:00am I came back from a journey unannounced on opening my door I saw my wife with another man on our bed so I held the guy struggling and my spouse is dragging away unfortunately the guy escaped.so I went to call few friends to come see what I saw but unfortunately before I could get to the house my wife call the police that I hit her so I was arrested two days later my pastor bailed me out.before the court hearing my wife wrote an affidavit of non prosecution to drop the case so the case was dismissed.unknown to me during that time my wife has withdrawn the I-130 petition she filed for me without my notice.we later reconcile and were called for first interview in sep 2024 and second interview on October 30th 2024.my master calendar hearing was November 12 2024.when I came the judge asked me if my I-130 has been approved I said still pending so he reschedule me for feb 14 2025.my lawyer wrote letter to USCIS requesting for decision and two weeks later USCIS replied with the withdrawal letter of my wife in 2022.i swear my life became devastated.February 14 2024 I got to the court with my lawyer and told the judge what my wife did to the I-130.I begged the judge if he can terminate my case so that I file for Vawa but the DHS(ICE) refused.so now my lawyer has no other options than to file for relief for me with the court.(Vawa cancellation of Removal).so the judge set my individual hearing for December 2025.please family what is my chance and what can I do to overcome this and get my petition granted by the judge?

@Ibe trust God she nevered told me about Vawa.she said since my spouse agreed to correct her mistakes we can file another petition

@Bobby zek I feel sorry for you, and also went into my past memories this how my spouse harassed me and mental breakdown!! but I would advise change your whole circle the wife and lawyer especially. these two people are making your life hell and playing with it intentionally knowing that you suffering and lawyer must ke staking bill after bill to you and your wife,uuuff what a character. please leave her alone if you want to live and came back from death bed the guy almost ended up killing me eventually died due to over drugs my lawyer advised me to file Vawa immediately after consulting 4 other big lawyers who took their fees but never had idea what simple logic they can use in my case since my petitioner died while pending I130. always take second opinion 95% people will put you through hell only 5% would give you true advice but that too not for free!!! take some break and think wisely

I think what you have said qualified you for Vawa if you have proof of what you wrote here! I filed for Vawa when I was in removal preceeding and my Vawa was approved… removal dismissed then I file I-485 waiting for decision!

@Bobby zek Immediately hire a good lawyer. Prepare a detailed self affidavit or story detailing in paragraphs how you met her, how long you lived with her and her injustice to you getting pregnant from somebody, with proofs you have from the DNA of other guy though she was your wife and living with you. This story will clearly support you provided if you hire a good lawyer from a reputed law firm. Sad to hear your life. You should had left her and filed VAWA instead of going through all this struggle and sufferings.

@Bobby zek don't rely on 42b the appointed trumps judge with the court are tricky and they will side with govt most of time better you file vawa with uscis. And hire a better lawyer.

@Bobby sorry to read what you passed through. After you discovered that Child wasn't urs, u should have left that marriage and filed for VAWA. Returning to that marriage after you discovered through DNA, was not a wise decision. Since you are in removal proceedings now, you have two options to file for VAWA. You can either file affirmative VAWA to USCIS if your divorce is not more than two years or you can file for VAWA cancelation of removal in the court with the judge. VAWA cancelation doesn't have more than two years divorce restrictions. you don't have to delay. Hire a good lawyer, leave or run from that marriage if you are still in it with your two legs and high speed. You are Lucy she didn't get you physically hurt. I had a child too in marriage to US wife that was later not mine after I did a DNA during our divorce. So, I know how painful and emotional wrecking it could be for you but in life, it is not what you passed through that really matter, it's how you were able to figure yourself out and solve it and get ur desired results That is what people want to hear unfortunately. Get up and fight hard...I went through all that, even I was in removal proceedings but today, I have my green card, now I am in a law school to specialize in Immigration law.

@Dream Daddy it is a terrible situation. I don’t even wish this for my enemy.anyway I have file Vawa cancellation of removal before the judge.hopefully the judge grants it with all the evidence I have presented

@Sind D I wanted to file for Vawa after I discovered she withdrew the I-130 petition.but the judge refused to give me time to go file Vawa so I opted to file Vawa cancellation of removal (42b) before the judge. I think they are same thing since I am in a removal proceeding.hopefully the judge approves it with all my evidence
