@tall man your info is not correct. They will not send 5years card because they approve vawa. Vawa comes with a 2yr EAD (c31). You only get 5 years if you apply for EAD under C09. They are 2 different categories of EAD and uscis will issue card based on the category you applied for.

Thanks everyone. I decided to call USCIS to get an official timeline on how long I485 takes for approved VAWA applicants. after verifying my identity, the agent told me that my approval officially restarts my pending I485 case and that it’s not outside of processing times so he went ahead and submitted a service request for me and told me to expect contact in no more than 60 days. I’m freaking out and I’m definitely going to start my medicals soon.

@Tohbz O Dod you get prima facie? how many? If so after how many after the last prima facie did you get your VAWA approved?

@Diosa Fuentes I am 100% right. the thing is most of you don’t know what you apply for. For some people, they submit i485, i360, i765, i131 together. when they are filing out the i765, they choose c09 which is why Uscis will send 5yrs EAD. For i360 approval itself, you get 2 yrs EAD. Although both are EADs, they are different Categories and validity. currently on Uscis website, vawa which is C31 comes with 2 yrs, while C09 5yrs. Can you check the category on the 5yrs EAD you have? let’s stop confusing people here

@Diosa Fuentes for your info, they don’t send 5yrs to everyone with vawa approval. If your spouse is a GC holder, you are not allowed to file i485/i765 C09 with your i360. so there’s no how they will send you 5yrs even if your vawa gets approved. Cos you will have to file your i485 after your vawa must have been approved. The only set of people that gets the 5yrs are people whose spouse are US citizens, they have the option of filing i360, i485, i765 C09 together. Hence the reason why must people get 2 EADs with different categories

To clarify everyone here, when your spouse is a U.S. citizen, you can file concurrently meaning you file i360, i485, i765 (c09) except you choose not to. when your spouse is a GC holder, you can only file i360 and i765(c31). The difference between c09 and c31 is that while your case is still pending, they’ll give you c09 so you can work. Meanwhile they will only issue c31 EAD when your vawa is approved. That’s why they don’t give c09 to everyone. You get it because your i485 is pending. So when your spouse is not a U.S. citizen, it means you don’t have an active i485 in place hence the reason why you don’t get c09 EAD. But if you spouse is a U.S. citizen and you filed concurrently, they will issue you c09 due to your pending i485 and c31 due to your vawa approval
