Vawa application
Hi everyone, I need some advice and hope. I applied for adjustment of status through marriage in 2020 and received my EAD. However, during my interview, my husband’s abusive behavior caused my case to be denied — he messed everything up on purpose. He was emotionally, physically, and psychologically abusive, as well as unfaithful. I filed for VAWA in August 2025 with all my evidence (psychological evaluation, medical reports, etc.). Has anyone been in a similar situation, with a denied marriage-based case before filing VAWA? How long did it take to get your prima facie, EAD, and travel document? Thank you.

I was in the same situation, i had my prima facie in 3 or 4 months , and my EAD in 6 months. I didn't file for travel document . it was in 2021, so as long you can prove everything, you will be okay. I wish you good luck .

it took me 7-8 months to get ead and ap and really didn’t care about pf it’s been almost two years since I filled, I think I’ve got 3 so far

@Ben Amisial please have you received a NTA after your case through mariage was denied ? After submit your vawa, your new application?

@liou ki yes I did receive it, but I had a lawyer who filed a prosecutorial discretion , and they closed my case . At this point you really need a lawyer.

@Ben Amisial Yes I have a lawyer, and I suprised the NTA said that I'm overstay with my parole( travel document) in 2023 even though my previous case was ben pending before denied, waiting my interview at the same time. Should I wondering ? what prosecutorial discretion? Thank you so much for your reply

@liou ki prosecutorial discretion is a waiver your lawyer can file before the sane judge who is presiding over your case to ask them to terminate your removal proceedings, but you should show good moral character. In my case , i didn’t have no trouble either the law , I was doing good in college . All that helped a lot.
