I did travel with a pending vawa like 5 times

@najila h I entered with a tourist visa a few years ago and today I am out of status, I am afraid of being stopped on re-entry, have you also been out of status and used your parole? what is the procedure at the airport on the way back? do they inspect your documents?

I entred on tourist visa too I was out of status for like 4 yrs but I never had a problem traveling with the AP

they just ask you for ur AP so they can stamped and stamp your passport

trust me taylor I was panicking like u or maybe worse before I traveled the first time then I realized it wasn’t even worth it to be nervous

@najila h I am very nervous and anxious, I have a 14 year old daughter who lives in my country of origin, she has some health problems, I wish I could go and see her, but I am in this impasse about immigration stopping me on my return , I cry almost every day

they won’t stop u trust me just don’t stay out of the country more than 3 weeks and if u don’t mind me asking which country I traveling to?

they stamped a paroled until....one year from the entry

so does that mean you can travel on that stamp within a year? or you always need your AP for re entry

I myself have my asylum which has been pending for 6 years and my wife and my two children are in Spain and I really want to go see them and I am thinking of taking an AP someone either what will happen on my return, I would have traveled for a good cause. Go see my children, especially the last one who keeps crying about my absence and starts refusing to talk to me on the phone.

I also have an approved i360/vawa and I want to travel on my AP. however I have fear of them not letting me back in the country

@Nene Lucky I think you would have no problems because your vawa is already approved, in my case it is still pending

@Nene Lucky mine has been pending for 23 months, I had an RFE, I replied 1 month ago, so I've been researching and talking to other people who are with vawa, may it be pending for another 6 months, how was your dates? did you have RFE?

yes I did have RFE I can't remember what they asked for at the time it's been so damn long filed 2015 and I was approved 2018 have faith girl

@Najla H thanks for sharing your experience my vawa is pending after my prima facie I filed for EAD, AP and i-145 I did my bio still waiting for my ead and AP I use to have Ead but got expired before before I was out of status

unless you are asylum/ removal proceedings, you are safe to travel outside of states using AP.

@stacie k how can I check if am not on removal proceeding because my former I-145 was denied and ask to leave the country in 2019 before I filed for vawa

you were asked to leave the country back in 2019? if you are in removal proceedings, you must gotten the letter from ICE with court date. Did you attend the court hearing? some of vawa applicants were already in removal proceedings when they filed VAWA. Judge is most likely postpone the case till your I-360 is granted by USCIS.

how do you know that “ you were asked to leave the country in 2019?” then? i don’t think you are in removal proceedings if you haven’t gotten the letter from ICE.

My attorney filed for FOIA before we start the whole VAWA process, just to make sure if ICE was after me since they went to see me when I got locked up in 2018. Luckily they never came back. I am afraid of leaving on AP because I have a criminal record for driving without a license. I guess I will find out... My mom got sick back in my country.

I went for the interview with my lawyer because my husband is in jail I show the IO the evidence that he’s in jail also gave her my husband booking case number, life insurance, joint account pictures wedding cart so they later sent a mail that my application was denied because my husband was not present and to leave the country in 33 days

@ Hilary mike you are not in removal proceeding. once your I-130 is denied, I-485 is automatically be denied and USCIS will send letter stating that you need to leave the country in certain time which you did. But YOU ARE NOT IN REMOVAL PRPCEEDING so don’t worry!

@hilary mike once your marriage based is denied, you will receive the letter from USCIS denial decision stating that you need to leave US in certain amount of time as I stated above. However, unless ICE sends the letter to you, you are neither in removal proceeding nor legal status. You already have VAWA case pending, and I assume you already have received your AP. You are safe to travel outside. if you are worried and have your lawyer, consult with him/her.

I had the exact same situation I had my ex last name but my passport with my father’s last name and yes u can travel with it just make sure to carry ur marriage certificate

@ Hilary Mike don’t worry. I told you before you didn’t get letter from ICE, you were just out of status n not in removal proceedings. my I-485 was denied before but I did traveled after I obtained my combo card, I had no issue re-entry just officer asking couple of questions. that’s was all.

Mas não, nada criminal, nem dirijo ainda aqui. Ficha sempre limpa. Antes de morar , eu entrei legalmente 5x (como turista). @hilary mike when you filed VAWA, did you submit application fee along with form? if so it is free. however if not and applied with fee waiver, yes, you need to pay in order to renew EAD/AP card. Please apply renewal 6month before expiration date since it is taking longer and longer ever before. hope you are doing well!
